A father in Florida lost the opportunity to witness the birth of his second child due to a shocking case of mistaken identity that led to his wrongful imprisonment for two weeks.

Samuel Vasquez, a 29-year-old dad from Jacksonville, was looking forward to the arrival of his daughter when he was arrested on assault charges and taken to Duval County Jail on September 12.

He was subsequently transferred to Polk County—over 200 miles away—to answer for crimes he did not commit in a location completely unfamiliar to him.

Meanwhile, the actually wanted man, 41-year-old Samuel Vazquez, who was accused of attacking his ex-girlfriend and her dog outside a grocery store in Polk County, remained free.

The only difference in their identities was a single letter in their last names, which mistakenly landed the expecting father in jail for almost two weeks while he desperately declared his innocence.

Aside from their similar surnames, the two men bore no further resemblance. Their ages, dates of birth, physical dimensions, and overall appearances were notably different.

Vasquez endured 13 long days incarcerated before his legal team from the Joshi Law Firm managed to demonstrate to the authorities that they had apprehended the wrong individual.

Vasquez detained for 13 days due to confusion with another man suspected of assault.

“An innocent person was arrested; an innocent person was incarcerated. In my 25 years of practicing law, I’ve never encountered such a shoddy investigation,” stated Rajan Joshi, a senior partner at Joshi Law Firm, in an interview with Fox 35.

Making things even more troubling, surveillance footage from the grocery store apparently captured Vazquez committing the alleged assault, yet law enforcement still believed they had the right person, many counties away from the crime scene.

In contrast, Vasquez had no previous criminal record, while Vazquez was reportedly on probation during the time of the alleged incident.

The only notable similarity between the two men was their last names.

“All law enforcement had to do was look—a simple comparison of the real suspect’s face next to the person they mistakenly accused would have clarified the situation immediately,” noted Jonathan Vega, an associate at Joshi Law Firm.

Taking actions that law enforcement did not, the attorneys visited Vazquez’s ex-girlfriend and showed her a picture of Vasquez’s recent mugshot.

While Vasquez was wrongfully imprisoned, his wife gave birth to their daughter.

“I showed her my client’s mugshot, and she replied, ‘I’ve never seen that man before,’” Vega recounted.

All charges against Vasquez were promptly dropped, and he was released from jail. Shortly thereafter, the correct Vazquez was arrested in Charlotte County and is currently pending extradition to Polk County, as per jail records.

The Post reached out to the Jacksonville Sheriff’s Department, whose officers were involved in the original arrest of Vasquez, for their comments.
