Edward Blum, a legal activist known for his successful U.S. Supreme Court challenge to affirmative action in college admissions, is now targeting an Illinois minority scholarship program for aspiring teachers. Blum’s group, the American Alliance for Equal Rights, has filed a lawsuit against Illinois officials over the Minority Teachers of Illinois Scholarship Program, which provides up to $7,500 per year to qualified minority applicants.

The program, which has been in place for 32 years, is open to individuals who identify as American Indian or Alaska Native, Asian, Black or African American, Hispanic or Latino, or Native Hawaiian or other Pacific Islander. Blum’s group argues that the race-based qualification violates the 14th Amendment’s equal protection clause.

In a lawsuit filed in U.S. District Court in Springfield, the state capital, the group asserts that the program’s discrimination against individuals who could contribute to the teacher pipeline in Illinois is demeaning, patronizing, un-American, and unconstitutional. This legal challenge comes on the heels of Blum’s group’s involvement in successful legal battles against race-based admissions at Harvard University and the University of North Carolina.

While the Supreme Court’s 2023 decision in Students for Fair Admissions v. President and Fellows of Harvard College did not directly address minority scholarships, it has sparked a wave of challenges to race-conscious programs in various sectors. For example, the Smithsonian Institution modified a Latino museum studies internship program to be open to non-Latinos following a lawsuit from the American Alliance for Equal Rights.

In response to the Supreme Court decision, some states, such as Missouri, have moved to end race-conscious policies, including minority scholarships. Missouri Attorney General Andrew Bailey instructed state universities and local governments to adopt race-blind standards for all programs that make admissions decisions based on race.

The Pacific Legal Foundation, which is representing Blum’s group in the lawsuit, is also challenging several K-12 education programs nationwide. These programs, which use socioeconomic criteria to promote diversity in student enrollment, have come under increased legal scrutiny in light of the Harvard decision.

In Illinois, the Minority Teachers of Illinois Scholarship Program, administered by the Illinois Student Assistance Commission, requires scholarship recipients to pursue teacher training and commit to teaching full-time for at least one year in schools with a significant minority student population. The lawsuit highlights the case of “Member A,” a high school senior who does not qualify for the minority scholarship but wishes to pursue a teaching career in Illinois.

As the legal battle unfolds, it remains to be seen how the courts will address the issue of race-based qualifications in scholarship programs and other race-conscious education policies.
