Alina Habba Forced To Resign After Judges Determine She Was Illegally Appointed

Alina Habba has announced her decision to step down from her position as the acting U.S. attorney for the district of New Jersey. In her resignation statement, she criticized the appeals court that deemed her appointment unlawful.

“In light of the Third Circuit’s ruling, and in order to protect the stability and reputation of the office that I hold dear, I have chosen to resign from my role as the U.S. Attorney for the District of New Jersey,” Habba stated on Monday.

Habba mentioned that she will continue to serve at the Justice Department as a senior adviser, stating, “My battle will now extend nationwide.”

Her temporary term as the top federal prosecutor in New Jersey came to an end in July.

After a panel of federal judges appointed her successor, a seasoned prosecutor, Attorney General Pam Bondi dismissed her from the position shortly thereafter. Subsequently, Habba declared herself as the acting attorney for New Jersey once again.

An appeals court recently ruled that the actions taken by the Trump administration were unlawful, confirming Habba’s lack of qualifications for the role and leading to her resignation on Monday.
