AVERTING A DISJOINTED REGULATORY LANDSCAPE FOR AI:

In a bid to safeguard American innovation in artificial intelligence, President Donald J. Trump has enacted an Executive Order aimed at preventing the emergence of a fragmented and costly compliance framework stemming from disparate state regulations.

  • The Executive Order mandates the Attorney General to create an AI Litigation Task Force designed to contest state laws that are unconstitutional, preempted, or otherwise detrimental to innovation.
  • It instructs the Secretary of Commerce to assess state AI regulations that clash with national priorities and to withhold funding from any state that enforces these conflicting laws. Other agencies are also encouraged to consider the absence of such laws as a criterion for eligibility in discretionary grant programs.
  • The Federal Trade Commission (FTC) and the Federal Communications Commission (FCC) are directed to implement measures that curtail states’ power to compel AI companies to mislead consumers, including evaluating whether mandates that require the incorporation of Diversity, Equity, and Inclusion (DEI) principles into AI models violate the FTC Act. They are also urged to contemplate a federal reporting and disclosure standard for AI systems.
  • The Order emphasizes the need for a cohesive national legislative framework that would supersede state laws that inhibit technological progress.

With this decisive action, President Trump aims to empower American technological innovators to remain competitive globally, thereby safeguarding national security and economic vitality in the AI era.

  • State legislatures have already proposed over 1,000 AI-related bills, leading to a convoluted array of regulations, disclosures, and reporting responsibilities.
  • States like California and Colorado are exploring mandates that could force AI companies to censor their outputs and infuse particular ideological perspectives into their programming.
  • By alleviating the compliance costs and developmental challenges imposed by inconsistent state laws, this Executive Order intends to lower barriers for entry into the AI market, boost innovation, and ensure that American companies are not hampered by restrictions that their global competitors do not face.
  • It is asserted that the most restrictive states should not be allowed to dictate national AI policy, especially when it jeopardizes America’s leadership in this pivotal technological frontier.

FACILITATING RATIONAL AI POLICY:

The Trump Administration advocates for a sensible approach to AI regulation, which entails eliminating unnecessary bureaucratic hurdles, updating antiquated rules that predate advancements in AI, and providing clarity on new regulations for specific sectors or applications.

  • President Trump commented: “Investment in AI is propelling the U.S. Economy to be the ‘Hottest’ in the World, yet overregulation from the states threatens to undermine this significant growth engine. Some states are even attempting to embed DEI ideology into AI models, giving rise to what I term ‘Woke AI’ (Remember Black George Washington?). We absolutely must establish a single federal standard rather than allowing a patchwork of 50 state regulatory regimes. Otherwise, we risk letting China overtake us in the race for AI supremacy.”
  • The Trump Administration is also dedicated to safeguarding the dignity, privacy, and safety of children in the digital landscape. In May 2025, President Trump signed the Take It Down Act, a legislative initiative led by the First Lady aimed at protecting young Americans from online deepfake exploitation.
  • This Executive Order builds upon President Trump’s commitment to promoting AI models that prioritize truth and accuracy. In July 2025, he signed an Executive Order barring the federal government from utilizing AI models that embody ideological biases or social agendas.
  • Today’s Executive Order is a continuation of President Trump’s AI Action Plan released in July 2025, which advocated for the review and elimination of burdensome regulations that obstruct America’s capacity to lead in this crucial technology.
