Luminar, a prominent lidar-maker, is currently facing challenges with its founder and former CEO, Austin Russell, as he has been evading requests for crucial information needed by the company to determine whether legal action should be taken against him. The company, which recently entered the Chapter 11 bankruptcy process, revealed in an emergency filing that it has been struggling to retrieve company-owned devices from Russell since his resignation in May. Despite recovering six computers, Luminar is still in pursuit of Russell’s company-issued phone and a digital copy of his personal phone.

In the filing, Luminar’s attorneys expressed frustration over Russell and his personal employees misleading legal representatives about his whereabouts during the holiday season. As a result, they are seeking court approval to serve Russell via mail or email. Russell, on the other hand, claimed to be cooperative and emphasized the need for assurances regarding the protection of his personal data from the devices.

The ongoing legal battle between Luminar and Russell has added a significant twist to the company’s bankruptcy proceedings, where it is looking to sell its semiconductor subsidiary to Quantum Computing, Inc. and inviting bids for its lidar division by January 9. Russell, through his new venture Russell AI Labs, had previously attempted to acquire Luminar before the bankruptcy filing and intends to make a bid in the current process.

The conflict between Luminar and Russell dates back to May when Russell resigned following an inquiry by the board’s audit committee. The company was exploring potential legal claims against him related to the audit committee inquiry and personal loans taken by Russell. Despite efforts to obtain information from Russell, including the establishment of a Special Investigation Committee and hiring of legal counsel, the process has been met with challenges.
