Department of Health and Human Services Demands $3.7 Million Repayment from Delaware

The Department of Health and Human Services is requesting that Delaware repay $3.7 million after state officials inaccurately claimed eligibility for funds to support low-income families.

Assistant Secretary Alex Adams informed Governor Matt Meyer that Delaware had until Jan. 14 to return the “contingency funding” from the Temporary Assistance for Needy Families (TANF) program.

TANF provides cash assistance for food, child care, early learning programs, and workforce training opportunities for impoverished families.

If the funds are not returned, Adams cautioned that future block grants to Delaware from the Administration for Children and Families (ACF) may be reduced.

Adams explained, “In order to be eligible to retain TANF Contingency Fund payments, a state must meet the requirement to maintain 100% of the applicable Maintenance of Effort (MOE) level.” He noted that Delaware officials had certified that they would provide matching funding but failed to meet the requirement.

Delaware’s Mismanagement of TANF Funding

Delaware needed to spend $24,826,042 in state funding in fiscal year 2024 to receive all federal funding. However, only $21,872,175 was disbursed by the state.

Additionally, state budget documents revealed that Delaware officials had requested a $4 million TANF contingency fund grant with no required state contribution.

Only 15 states received federal TANF contingency funding in fiscal year 2024, with nearly 7,000 families served in Delaware.

Oversight of Federal Welfare Programs

TANF is projected to allocate over $16 billion in cash assistance to needy families this fiscal year. It is one of the top three block grant programs managed by the federal government, alongside the Department of Housing and Urban Development’s Community Development Block Grants and the Child Care Development Fund program.

Adams’ message comes in the wake of HHS freezing more than $10 billion in federal child care and social services funding for several states before being challenged by a federal judge.

New York US District Judge Arun Subramanian issued a temporary restraining order against the funding freeze following a lawsuit filed by attorneys general from affected states.

Fraudulent Activities in Welfare Programs

The Trump administration had targeted Minnesota, New York, Illinois, Colorado, and California for alleged fraudulent activities in federally funded welfare programs.

Past FBI investigations in Minnesota uncovered widespread fraud, with convictions related to wrongful payments amounting to $250 million.

Conservative YouTuber Nick Shirley’s investigation into fraudulent child care centers in Minnesota gained national attention and led to further scrutiny of the state’s welfare programs.

Minnesota Governor Tim Walz decided not to seek a third term amid the scandal, emphasizing the need to combat fraud and regain public trust.

Investigations by HHS, the Treasury Department, and the House Oversight Committee continue to uncover fraudulent activities in welfare programs across the country.

Despite the challenges posed by fraud, efforts are being made to ensure the effective delivery of programs and services to those in need.
