An undocumented immigrant who was released into the United States by the Biden administration is facing charges after allegedly causing a fatal crash during a police chase in California. Darwin Felipe Bahamon Martinez, a 21-year-old Colombian national, was apprehended by authorities after crossing the California-Mexico border illegally in August 2023. Despite being detained, he was later released back onto the streets, as reported by ICE.

The incident occurred on January 21 when Bahamon Martinez led police in Anaheim on a three-minute chase after officers attempted to pull him over for driving recklessly. The pursuit ended in a tragic crash in Placentia, where he collided with two vehicles, resulting in the death of 59-year-old Jose Antonio Ramos Hernandez and injuring an 83-year-old woman.

ICE issued a statement condemning the release of Bahamon Martinez under the Biden administration’s “catch-and-release” policies, suggesting that the victim may still be alive if he had not been let go. The Colombian national is now facing charges of vehicular manslaughter, evading a police officer causing death, and reckless driving, and is being held in Orange County Jail on a $2 million bail.

Although ICE has lodged an immigration detainer against Bahamon Martinez, California’s sanctuary state laws do not require local authorities to transfer undocumented individuals charged with crimes into federal custody. ICE has urged California to honor the immigration detainer to prevent further risks to the community. Failure to comply could result in ICE re-arresting the criminal illegal alien if he is released back into the community.

The case highlights the ongoing debate surrounding immigration policies and the enforcement of federal immigration laws in states like California. The tragic outcome of this incident underscores the need for a comprehensive approach to addressing immigration issues while ensuring the safety of all residents.
