Warner Bros. is currently facing a legal battle with the estate of Michael Crichton over their upcoming Max series, “The Pitt,” which the estate claims is an unauthorized reboot of the iconic medical drama “ER.”

Michael Crichton, the creator of “ER,” wrote the original pilot script based on his own experiences as a medical student. His widow, Sherri, filed a lawsuit in August, accusing John Wells, Noah Wyle, and others of creating “The Pitt” without her permission, alleging that it is essentially “ER” under a different title.

In response, Warner Bros. has filed a motion seeking to dismiss the lawsuit, arguing that “The Pitt” is a distinct show from “ER.” The studio contends that the idea of setting a show in a hospital is not unique, citing other medical dramas like “St. Elsewhere,” “Grey’s Anatomy,” and “House.”

The lawsuit pointed out several similarities between the two shows, including Noah Wyle starring in both series. However, Warner Bros. asserts that “The Pitt” has different plots, characters, themes, settings, and pacing compared to “ER.” They also highlight that “ER” was subject to network restrictions on language and nudity, while “The Pitt” is a streaming show free from such limitations.

Sherri Crichton claims that John Wells initially attempted to reboot “ER” for Max in 2020 without her knowledge. When she found out about it in 2022, negotiations on how to properly credit and compensate the estate broke down, leading Wells to create “The Pitt” instead.

Warner Bros.’ lawyers argue that “The Pitt” is not a derivative work of “ER” under copyright law, as it is not substantially similar to the original series. They cite previous copyright cases involving Crichton, where he prevailed as the defendant.

Sherri Crichton has criticized Warner Bros. for filing the motion on the anniversary of her husband’s death, accusing the studio of disregarding Crichton’s legacy. She maintains that the estate will present its case to a jury and is confident of prevailing in the legal battle.

In conclusion, the dispute between Warner Bros. and the estate of Michael Crichton over “The Pitt” and its alleged similarities to “ER” remains ongoing, with both parties firmly standing their ground.
