Police bodycam footage reveals a chilling scene as an accused cop killer grins while handcuffed on the ground, just after allegedly shooting NYPD officer Jonathan Diller.
This gripping footage was shown to jurors on Wednesday during the Queens murder trial of Guy Rivera, accused in the 2024 killing. NYPD Detective Derval Whyte broke down emotionally on the witness stand as he recounted Diller’s last moments.
“I just watched my friend get shot for no reason,” Whyte testified.
“He’s on his back, he’s motionless,” Whyte described Diller’s condition. “I heard him say, ‘I’ve been shot.’ I went over to find the gunshot wound. I rolled him back and forth and found the bullet wound above his belly.”
When asked to describe the footage, Whyte said, “That’s the defendant. He looks like he’s smiling.”
Diller, a 31-year-old married father, was investigating a suspicious vehicle in Far Rockaway on March 25, 2024, when Rivera allegedly opened fire, fatally wounding him.
Rivera, who was injured in the shootout, was subdued and taken into custody.
Diller’s widow, Stephanie Diller, has attended the trial, supported by numerous NYPD officers. She exited the courtroom before videos of her husband’s death were shown to the jury.
On the stand, Whyte detailed how Rivera is seen in the footage removing his seatbelt while questioned by police, then pulling out a gun and shooting Diller.
“Oh my God,” Whyte is heard exclaiming in the video. “Dilly! Oh f—k, bro!”
He then became emotional and required two minutes to regain his composure.
