After the recent developments in the antitrust lawsuit against NASCAR, it has been confirmed that the teams involved in the lawsuit, namely Michael Jordan’s 23XI Racing and Front Row Motorsports, will indeed be racing in 2025. The teams announced on Saturday morning that NASCAR has modified the 2025 “open” agreement for all teams by eliminating a clause that previously prevented them from taking legal action. This development comes in the midst of an injunction request that is currently being appealed.

While the teams are still pursuing a court order to race as “charter” teams, which would grant them guaranteed entry into each race and higher payouts, the removal of the anticompetitive release requirement in the open agreement means that 23XI and Front Row will at least be allowed to participate in each race. This news provides reassurance to their drivers and sponsors that they will continue to compete as the lawsuit progresses.

Attorney Jeffrey Kessler, representing the teams, expressed their satisfaction with NASCAR’s decision to remove the clause, allowing them to race as open teams in 2025. However, the appeal to the Fourth Circuit to run as chartered teams in order to avoid irreparable harm will continue.

Racing as open teams does present a competitive risk, as drivers would have to qualify their way into the field if more than 40 cars show up for an event like the Daytona 500. This means that popular drivers such as Bubba Wallace and Tyler Reddick could potentially miss out on races.

The legal battle between NASCAR and the teams began on Nov. 4, when the teams sought a preliminary injunction from U.S. District Court Judge Frank Whitney. The judge denied their request on Nov. 8, stating that it was premature for the teams to claim irreparable harm at this stage.

The teams have since appealed Whitney’s decision to the Fourth Circuit Court of Appeals, although a date for a potential hearing has not yet been set. NASCAR has not provided any immediate comment on the matter.

As the lawsuit continues to unfold, the future of NASCAR and the teams involved remains uncertain. However, the recent developments ensure that 23XI Racing and Front Row Motorsports will be taking to the track in 2025, albeit with some uncertainties regarding their racing status.
