A PROCLAMATION
Proclamation Overview: In the original Proclamation 9704 dated March 8, 2018, later amended, it was determined under section 232 of the Trade Expansion Act of 1962 (19 U.S.C. 1862) that the importation of aluminum into the United States was occurring in amounts or conditions that posed a potential threat to national security. To counter this, a tariff system was put in place, involving ad valorem duties on specified aluminum imports and related products. This system was later refined in Proclamation 11021 on April 2, 2026, and Proclamation 11032 on June 1, 2026, to better address the concerns outlined in Proclamation 9704.
Monitoring and Recommendations: In these proclamations, I instructed the Secretary of Commerce to assess the impact of aluminum imports on national security, keep me informed, and offer recommendations for further Presidential actions under section 232 if needed.
Secretary’s Assessment: Based on the Secretary’s evaluations, I have received insights and suggestions concerning the tariff system established in Proclamation 9704 and the associated national security risks.
Impact of Duties: According to the Secretary, the additional ad valorem duties on aluminum imports have bolstered the American aluminum industry and mitigated the national security concerns identified in Proclamation 9704. The Secretary believes that without these tariffs, domestic aluminum production and industry strength would be weaker, and the security threat would be more pronounced.
Need for Tariff Regime Modification: Despite the benefits of the current tariff system, the Secretary notes that the domestic production and supply of primary aluminum remain insufficient, which is vital for the U.S. economy and defense. The Secretary suggests modifying the tariff regime to better promote increased domestic production of primary aluminum.
Incentives for Production Expansion: To maintain the effectiveness of the aluminum tariff regime against the national security threat, the Secretary recommends creating incentives for companies to build new facilities, expand existing ones, or refurbish outdated facilities to increase primary aluminum production. This would involve allowing these companies to import primary aluminum at a reduced tariff rate, proportional to the anticipated production from these projects. This strategy builds on a program initiated for specific aluminum and steel imports from Canada and Mexico in Proclamation 10984 of October 17, 2025.
Decision to Modify Tariff Regime: After reviewing the latest information, advice, and relevant factors, I have concluded that altering the tariff regime for aluminum imports is necessary. This includes establishing an investment incentive program to enhance U.S. production capacity for primary aluminum, as detailed below. I believe these changes will ensure the tariff system continues to address the national security threat effectively.
Authority to Adjust Imports: Section 232 allows the President to adjust imports that threaten national security, ensuring they do not impair national security.
Authority for Tariff Modifications: Section 604 of the Trade Act of 1974, as amended (19 U.S.C. 2483), empowers the President to incorporate statutes affecting import treatment into the Harmonized Tariff Schedule of the United States (HTSUS), including modifying or imposing duty rates or other import restrictions.
NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by the authority vested in me by the Constitution and laws of the United States, including section 232, section 604, and section 301 of title 3, United States Code, do hereby proclaim as follows:
Establishment of Investment Incentive Program: The Secretary is authorized to create a program to incentivize new investment in U.S. facilities for primary aluminum production.
Onshoring Plans: The Secretary can solicit and accept onshoring plans from companies. Each plan must include a commitment to build, refurbish, or expand a U.S. facility for primary aluminum production, with construction starting by January 20, 2029, and any additional information required by the Secretary.
Approval of Onshoring Plans: The Secretary can approve plans based on factors such as start date, project timeline and milestones, anticipated annual production, cost and production projections, and benefit allocation of reduced tariffs. Approval must align with addressing the national security threat outlined in Proclamation 9704.
Tariff Adjustments for Approved Plans: Approved companies can import primary aluminum at half the section 232 duty rate, corresponding to projected annual output post-completion. Adjustments for refurbishment are based on the investment value.
Implementation and Monitoring: The Secretary is empowered to implement the program, issue regulations, and enforce approved plans. Companies must submit compliance reports, which may be audited externally. If a company fails to meet commitments, the Secretary can rescind tariff benefits, retroactively if fraud is involved, and collect additional tariffs as needed.
HTSUS Modifications: The Secretary, consulting with relevant officials, will determine and implement necessary HTSUS modifications through the Federal Register.
Ongoing Monitoring: The Secretary will continue monitoring aluminum imports and inform me of circumstances requiring further action or indicating that current actions are unnecessary.
Implementation Authority: The Secretary and Secretary of Homeland Security are directed to take necessary actions to implement this proclamation, including regulatory changes and utilizing powers granted to the President. Agency heads may redelegate authority as needed.
Supersession of Inconsistent Provisions: This proclamation overrides any conflicting provisions in previous proclamations and Executive Orders.
Severability Clause: If any part of this proclamation is found invalid, the rest remains effective.
