A Proclamation
In Proclamation 11046, dated July 20, 2026, I identified a situation where Canada was actively discriminating against American commerce. This was evident as Canada restricted the purchase, distribution, and retail of U.S. alcoholic beverages, while not imposing similar restrictions on products from other nations. Such actions placed U.S. commerce at a disadvantage compared to other countries. To counteract this, under section 338 of the Tariff Act of 1930 (19 U.S.C. 1338), I implemented additional ad valorem duties, effective August 19, 2026, specifically targeting certain Canadian products.
On August 18, 2026, under Proclamation 11056, I temporarily paused these additional duties for three days. This decision followed Canada’s assurance to eliminate the discriminatory practices highlighted in Proclamation 11046.
However, on August 21, 2026, Canada failed to uphold its promise, discontinuing negotiations in good faith and not addressing the discriminatory issues highlighted in Proclamation 11046.
Consequently, at 12:01 a.m. eastern time on August 22, 2026, the three-day suspension ended, and the additional ad valorem duties from Proclamation 11046 were reinstated.
I have since received insights and recommendations from senior executive branch officials regarding the current situation in Proclamation 11046. This includes evaluations of how the imposed duties are mitigating the burden on U.S. commerce. Although these duties are effective, modifying the range of products subject to these duties could further benefit the public interest. My advisors believe such modifications align with the broader interests of the United States.
After reviewing the information and recommendations, I have concluded that modifying the scope of products subject to additional ad valorem duties, as stipulated in Proclamation 11046, is necessary to serve the public interest.
In my view, the adjustments in this proclamation will continue to offset the disadvantage on U.S. commerce, align with the public interest, and better serve the United States.
Section 338 empowers the President to impose additional duties, up to 50 percent ad valorem, when a foreign country’s actions disadvantage U.S. commerce. These duties can take effect no sooner than 30 days after the President identifies such discriminatory actions. Section 338 also allows the President to amend or revoke any proclamation, and to exclude foreign articles from importation if discrimination persists.
Section 604 of the Trade Act of 1974, as amended (19 U.S.C. 2483), permits the President to integrate statutes affecting import treatment into the Harmonized Tariff Schedule of the United States (HTSUS), including changes in duty rates or import restrictions.
NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by the authority vested in me by the Constitution and U.S. laws, including section 338; section 301 of title 3, United States Code; and section 604, do hereby proclaim the following:
(1) Unless otherwise stated in this proclamation, specific Canadian products listed in Annex I, Part A, imported into the U.S., will face an additional ad valorem duty of 50 percent as per Proclamation 11046. However, certain Canadian products in Annex I, Part B will no longer be subject to this duty. These duties, as adjusted in this proclamation, will be applied alongside those under section 232 of the Trade Expansion Act of 1962. These changes will be effective for goods imported for consumption on or after 12:01 a.m. eastern time on September 15, 2026.
(2) The HTSUS is updated as detailed in Annex II, effective for goods entered for consumption on or after September 15, 2026, and will remain in effect unless changed or revoked.
(3) Leaders of each executive department and agency are authorized and instructed to take necessary actions within their powers to implement this proclamation. They may delegate this authority as permitted by law.
(4) The Commissioner of U.S. Customs and Border Protection (CBP) is authorized, in consultation with relevant officials, to issue the necessary rules and take actions to implement this proclamation.
(5) The Commissioner of CBP, in consultation with relevant authorities, will determine if further modifications to the HTSUS are needed to implement this proclamation and will make such changes through notice in the Federal Register.
(6) Any CBP rule or regulation related to this proclamation requires approval by the President or the United States Trade Representative. The Trade Representative is delegated this approval authority.
(7) Any conflicting provisions from previous proclamations are superseded by this proclamation.
(8) If any part of this proclamation is deemed invalid, the remaining provisions will still apply.
