EXCLUDING CERTAIN CANADIAN PRODUCTS FROM IMPORTATION INTO THE UNITED STATES IN RESPONSE TO CONTINUED DISCRIMINATION AGAINST THE COMMERCE OF THE UNITED STATES WITH RESPECT TO ALCOHOLIC BEVERAGES

BY THE PRESIDENT OF THE UNITED STATES OF AMERICA

A PROCLAMATION

1. In Proclamation 11046, dated July 20, 2026, which imposed additional duties to counteract Canadian discrimination against U.S. commerce concerning alcoholic beverages, I established that Canada was unfairly discriminating against the U.S. by banning American alcoholic beverages while allowing similar products from other countries. This action put U.S. commerce at a disadvantage. To counter this, I applied additional ad valorem duties on select Canadian products, effective August 19, 2026, under section 338 of the Tariff Act of 1930 (19 U.S.C. 1338).

2. In Proclamation 11056 on August 18, 2026, I temporarily suspended these additional duties for three days after Canada pledged to address the discriminatory actions identified in Proclamation 11046.

3. On August 21, 2026, Canada failed to fulfill its commitment, stopped negotiating earnestly, and did not rectify the discriminatory practices highlighted in Proclamation 11046.

4. Consequently, at 12:01 a.m. Eastern Time on August 22, 2026, the temporary suspension under Proclamation 11056 expired, thereby making the additional ad valorem duties from Proclamation 11046 active.

5. Based on information and advice from senior executive branch officials regarding Proclamation 11046 and negotiations with Canada, it was reported that Canada did not eliminate the discriminatory practices against U.S. alcoholic beverages. Instead, they maintained these practices and retaliated further. For instance, on August 27, 2026, Saskatchewan, one of two provinces not fully banning U.S. alcoholic beverages at the time of Proclamation 11046, declared an additional 50 percent levy on these beverages, effective September 8, 2026. This move was a direct response to the duties imposed by Proclamation 11046. According to senior officials, an import ban on certain Canadian alcoholic beverages subject to the duties in Proclamation 11046 aligns with U.S. interests and public welfare.

6. After evaluating the information and recommendations provided, I conclude that Canada has maintained or increased its discriminatory practices against U.S. commerce as described in Proclamation 11046.

7. I have determined that it aligns with the interests of the United States to issue this proclamation, directing that certain Canadian products subject to the additional ad valorem duties in Proclamation 11046 be banned from U.S. importation. This exclusion of specific Canadian alcoholic beverages, detailed in the Annex to this proclamation, is consistent with public interests.

8. In my assessment, the actions within this proclamation align with public interests and are necessary for serving the interests of the United States.

9. Section 338 grants the President the authority to counteract burdens on U.S. commerce due to unfair foreign practices by imposing additional duties not exceeding 50 percent ad valorem. These duties cannot take effect sooner than 30 days after the President’s proclamation. Furthermore, Section 338 allows the President to modify or revoke such proclamations as needed for public interest. It also permits the exclusion of foreign articles if the discrimination continues, deemed consistent with U.S. public interests.

10. Section 604 of the Trade Act of 1974 empowers the President to incorporate actions affecting import treatment into the Harmonized Tariff Schedule of the United States (HTSUS), including any changes or impositions of duty rates or restrictions.

NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, under the authority granted by the Constitution and U.S. laws, including section 338; section 301 of title 3, United States Code; and section 604, hereby proclaim:

(1) Except as specified otherwise in this proclamation, certain Canadian alcoholic beverages listed in the Annex are banned from U.S. importation, effective for goods imported on or after 12:01 a.m. Eastern Time on September 29, 2026.

(2) Products subject to this import ban that were imported but not yet entered for consumption or withdrawn from warehouses before September 29, 2026, will continue to be subject to the 50 percent duty rate from Proclamation 11046.

(3) This proclamation alters only those products changing from being subject to additional ad valorem duties under Proclamation 11046 to being banned from importation. It does not affect other products subject to duties as outlined in the Proclamation of September 8, 2026, regarding Canadian alcoholic beverages.

(4) Heads of executive departments and agencies are authorized and required to take appropriate measures within their authority to implement this proclamation. They may redelegate this authority as needed within the agency, consistent with applicable law, including section 301 of title 3, United States Code.

(5) The Commissioner of U.S. Customs and Border Protection (CBP), in consultation with the Secretary of the Treasury, the Secretary of Commerce, and the United States Trade Representative, is authorized to issue necessary rules, regulations, and determinations to enforce this proclamation and administer the import ban.

(6) The Commissioner of CBP, in consultation with relevant officials, shall determine if further modifications to the HTSUS are needed to execute this proclamation and make such changes through notices in the Federal Register.

(7) For any rules or regulations the Commissioner of CBP establishes, the approval of the President or the United States Trade Representative is required, with the Trade Representative granted the President’s approval authority in 19 U.S.C. 1338(h).

(8) Any provisions in previous proclamations and Executive Orders conflicting with this proclamation are overridden to the extent of the inconsistency.

(9)(a) If any part of this proclamation or its application is deemed invalid, the rest remains unaffected.

(b) If the import ban is invalidated in any way, the 50 percent ad valorem duty from Proclamation 11046 will apply to the affected imports. Other import bans or duties remain unaffected. This severability clause is consistent with U.S. public interests.
