Healthcare Professionals Challenge Houston Methodist Hospital’s COVID-19 Vaccine Mandate

A group of over 100 healthcare professionals has taken their opposition against Houston Methodist Hospital’s COVID-19 vaccine mandate to the Fifth Circuit Court of Appeals. The lawsuit, filed in a federal court in Galveston in 2023, accuses the hospital and its CEO Marc Boom of violating federal agreements by mandating employees to receive federally owned investigational drugs under the threat of penalties.

Medical ethics expert Brian Ward, a consultant, has weighed in on the case, emphasizing that the drugs mandated by Houston Methodist are classified as investigational new drugs by the FDA. For example, the Pfizer-BioNTech COVID-19 Vaccine is still under an Investigational New Drug (IND) application and should only be administered under laws regulating investigational drug treatments.

Ward argues that Houston Methodist’s actions go against fundamental principles governing investigational medical treatments. He asserts that the hospital should have obtained explicit consent from individuals before administering the drugs, as required by federal regulations.

The case’s roots can be traced back to the 1974 National Research Act, which led to the creation of the Common Rule to protect individuals from being coerced into participating in federally funded investigational drugs. Ward emphasizes the importance of legally effective informed consent, which goes beyond mere consent and ensures that individuals are not under pressure to participate in drug administration.

Federal District Court Judge George C. Hanks Jr. dismissed the case, a decision that Ward believes violates the Separation of Powers Doctrine. Ward criticizes the judge’s ruling, which he sees as overlooking Congress’s authority to prohibit coercion in drug administration.

Ward raises concerns about the implications of the ruling, stating that it could set a dangerous precedent where entities like Houston Methodist could pressure individuals to use unapproved medical treatments. The appeal brief filed with the Fifth Circuit Court reveals a legal framework designed to protect individuals from coercion in medical treatments. Ward hopes that this framework will prevent situations like the one at Houston Methodist from occurring in the future.
