The Trump administration recently made a surprising decision to reverse course on terminating the visa registrations of hundreds of foreign students. This move comes after facing backlash from rising criticism and legal judgments stemming from its pressure campaign against universities.

In a court filing last Friday, the Department of Justice announced that it would reinstate the necessary records for students to be eligible for a student visa. This decision was made pending the issuance of a new policy on how to legally rescind students’ rights to study in the United States.

The sudden reversal followed intense criticism from US universities, which heavily rely on international students who pay substantial tuition fees. Students affected by the visa cancellations also took legal action against the Trump administration. This shift highlights the ongoing turbulence in Donald Trump’s aggressive anti-immigration campaign, which has faced multiple legal challenges in federal courts.

The decision has left approximately 1,500 students in a state of uncertainty regarding their visa status. It remains unclear whether students who have already left the US will be able to reapply for visas and have them issued at consulates abroad, as stated by Fanta Aw, the chief executive of Nafsa, a group representing universities involved in international education.

The Justice Department’s announcement on Friday indicated that it would restore the records that were removed from the Student and Exchange Visitor Information System (Sevis). Many of these records were terminated without explanation, with some cancellations being a result of minor infractions such as traffic violations.

Tricia McLaughlin, the Department of Homeland Security assistant secretary, clarified that this action does not impact the separate wave of detentions and deportations targeting foreign students linked to pro-Palestinian protests on national security grounds.

Despite the reinstatement of Sevis records, Aw cautioned that this move does not signify an end to the crackdown on foreign students. She suggested that the administration could introduce new and stricter regulations in the future, potentially allowing any violations to serve as grounds for visa revocation.

The White House has yet to provide a comment on the matter.
