The lawsuit, filed by Antonio Martinez under North Carolina’s “alienation of affection law,” seeks $100,000 in damages as well as a jury trial. Martinez accuses Smith of intentional and negligent infliction of emotional distress.

Antonio Martinez and his estranged wife, Nicole Martinez, married in September 2021 and separated in February 2025 after Antonio discovered that Smith had been in contact with Nicole. The couple, who have a blended family of six children, including one biological son, were living together in Baltimore County, Maryland. Antonio is a retired police officer, while Nicole formerly played in the Ravens’ marching band. Smith, on the other hand, works as a sports analyst for NFL Network.

The lawsuit alleges that Smith met Nicole while filming an episode for the NFL Network in Baltimore, where he provided his phone number to communicate with her. Their communication reportedly turned sexual, including the exchange of explicit messages, photos, and videos. In January 2025, during the Ravens’ playoff game against the Buffalo Bills, Smith allegedly arranged to meet Nicole at a hotel where they engaged in a sexual encounter.

After discovering the messages between Smith and Nicole, Antonio confronted Smith over the phone, accusing him of having an affair with his wife. Despite Smith’s apology, Antonio expressed his disappointment, stating that Smith knew Nicole was married and calling him out for not taking responsibility for his actions.

Antonio filed for divorce from Nicole in February 2025, including emotional photos from their wedding day and a picture of the ex-couple with their infant son. The lawsuit paints a picture of a marriage torn apart by infidelity and betrayal, with legal consequences now unfolding in the courtroom.
