Colorado man hit in the eye by Rockies foul ball sues team

A lawsuit was filed in Denver District Court by a Parker man against the Colorado Rockies for negligence after being hit in the face by a foul ball while in a Coors Field luxury box. The incident occurred during a game against the New York Yankees on July 16, 2023, resulting in “catastrophic and permanent injuries” for Timothy Roeckel, as stated by attorneys from Denver firm Nielsen Weisz.

Roeckel was a guest of the box owner and did not purchase a ticket. The lawsuit claims that architectural elements obstructed Roeckel’s view of the foul ball, making it impossible for him to see it coming.

While Colorado law typically protects stadiums from liability in such cases, Roeckel’s attorneys argue that the Rockies did not take reasonable measures to ensure fan safety. They point out that the team failed to extend netting to protect fans, despite being warned about the risk of foul balls by engineers. Additionally, the lawsuit mentions the team’s focus on off-field amenities and socializing, which may have contributed to a lack of fan vigilance.

The lawsuit seeks damages and a jury trial. The Rockies have not yet commented on the case.
