A Man Sues RTD for Negligence After Being Hit by A Line Train

In a recent court case, Paul Aguilar is suing the Regional Transportation District (RTD) for negligence after being hit by an A Line train in 2023. The lawsuit claims that the train operator’s reckless operation and the dangerous condition of the Peoria Station led to the crash.

Aguilar, who was using a wheelchair, was waiting at the pedestrian crossing gates when he attempted to cross the tracks. Unfortunately, he was unaware of an eastbound RTD train approaching, as the warning signs were blocked and the sounds signaling an incoming train were similar to those of a departing train.

As a result of the collision, Aguilar suffered multiple fractures and was hospitalized for over three weeks. The lawsuit highlights safety issues at the station, including the lack of locking mechanisms on the pedestrian gate, inadequate signage, and a failure to differentiate between arriving and departing trains.

Both RTD and Denver Transit Partners, also named in the lawsuit, are accused of failing to maintain a safe environment at the station despite previous incidents of injuries and fatalities. RTD declined to comment on the ongoing legal proceedings, while Denver Transit Partners did not respond to requests for comment.

Represented by Adam Detsky of Ramos Law, Aguilar filed the lawsuit in Denver County District Court. A review hearing is set for July 28.
