PBS is refusing to play along with Donald Trump’s autocratic tendencies. The network, famed for its groundbreaking childrenâs programming like Mister Rogersâ Neighborhood and Sesame Street, is taking a stand for constitutional integrity amidst threats to its funding.
According to the lawsuit:
No matter the disagreements regarding public television’s role, the Constitution clearly prohibits the President from dictating PBSâs programmingâespecially through funding threats.
Since Congress established the framework for public television over fifty years ago, it has been vigilant in safeguarding federal funding from political meddling by routing it through the independent, non-profit Corporation for Public Broadcasting (CPB). This structure was intentionally designed to prevent any executive overreach, with a specific prohibition stating that no federal entity may âexercise any direction, supervision, or control over public telecommunications, or over [CPB] or any of its granteesâ regarding content. This is codified in 47 U.S.C. § 398(a), (c).
Trumpâs executive order blatantly violates these legal constraints and infringes upon First Amendment rights. It openly seeks to cut funding for PBS due to its programming content, which is a clear case of viewpoint discrimination and an attempt to manipulate editorial decisions.
