PBS is refusing to play along with Donald Trump’s autocratic tendencies. The network, famed for its groundbreaking children’s programming like Mister Rogers’ Neighborhood and Sesame Street, is taking a stand for constitutional integrity amidst threats to its funding.


According to the lawsuit:

No matter the disagreements regarding public television’s role, the Constitution clearly prohibits the President from dictating PBS’s programming—especially through funding threats.

Since Congress established the framework for public television over fifty years ago, it has been vigilant in safeguarding federal funding from political meddling by routing it through the independent, non-profit Corporation for Public Broadcasting (CPB). This structure was intentionally designed to prevent any executive overreach, with a specific prohibition stating that no federal entity may “exercise any direction, supervision, or control over public telecommunications, or over [CPB] or any of its grantees” regarding content. This is codified in 47 U.S.C. § 398(a), (c).

Trump’s executive order blatantly violates these legal constraints and infringes upon First Amendment rights. It openly seeks to cut funding for PBS due to its programming content, which is a clear case of viewpoint discrimination and an attempt to manipulate editorial decisions. Moreover, it imposes unconstitutional conditions on PBS Member Stations’ access to federal funds, effectively punishing them for perceived political slights. Such actions grossly undermine the First Amendment’s protections of speech and press freedom.

In a bold move, PBS is not merely suing an agency; they are directly targeting President Trump and members of his administration.

It’s crucial to note that the Corporation for Public Broadcasting operates as a private entity. Trump’s efforts to control and defund it represent a troubling encroachment on private enterprise.

This situation exemplifies a deeply undemocratic approach. PBS is a bastion of free media; viewers are not required to pay for subscriptions to access its content, making it a vital resource for all Americans.

As a non-partisan media platform accessible to everyone, PBS’s existence stands in stark contrast to Trump’s apparent desire to dismantle it.

From purging White House transcripts to withholding details about administration activities, a consistent theme of Trump’s presidency has been to restrict information flow, thereby keeping the populace less informed.

PBS plays an essential role in educating and informing citizens of all ages, and its defiance against Trump’s authoritarian maneuvers is crucial for preserving democratic values and the fabric of American society.
