Mondelez International Sues Aldi Over Packaging Dispute

Snack food giant Mondelez International has taken legal action against Aldi, claiming that the supermarket chain’s store-brand cookies and crackers packaging closely mimics Mondelez’s popular products like Chips Ahoy, Wheat Thins, and Oreos.

In a lawsuit filed in Illinois, Mondelez, based in Chicago, alleges that Aldi’s packaging is likely to confuse customers and harm Mondelez’s brands. The company is seeking damages and a court order to prevent Aldi from selling products that infringe on its trademarks.

Aldi, headquartered in Batavia, Illinois, has not yet responded to the allegations.

The lawsuit includes side-by-side comparisons of the products in question, highlighting similarities in packaging design such as Aldi’s Thin Wheat crackers being packaged in a gold box similar to Wheat Thins, and Aldi’s chocolate sandwich cookies having blue packaging like Oreos.

Known for its low prices and own-label products, Aldi has rapidly expanded in the U.S. with over 2,500 stores in 39 states. The company recently announced a new CEO for its U.S. operations.

This is not the first time Aldi has faced legal challenges over packaging. Previous cases include copyright infringement claims from Baby Bellies snack puffs and design similarities with Thatchers lemon cider packaging.

Mondelez alleges that despite previous communications with Aldi regarding the issue, Aldi continued to sell products with confusingly similar packaging, infringing on Mondelez’s trade dress rights.

The legal battle between Mondelez and Aldi underscores the importance of protecting intellectual property rights in the competitive food industry.
