MEMORANDUM FOR THE ATTORNEY GENERAL
THE COUNSEL TO THE PRESIDENT

SUBJECT: Reviewing Certain Presidential Actions

By the authority granted to me as President under the Constitution and laws of the United States, I hereby issue the following directive:

Section 1. Background. The President serves as the singular leader of the executive branch, wielding substantial power and responsibility. A mere signature can transform ideas into law, appoint individuals to prestigious positions, shape national policies, and even grant freedom to incarcerated individuals. In essence, the governance of our Nation hinges on the President’s signature.

Recent revelations indicate that former President Biden’s aides may have exploited this power, employing an autopen to mask Biden’s cognitive decline while asserting his authority under Article II. This situation could potentially be one of the most alarming scandals in American political history. The public was seemingly shielded from the truth of who was truly exercising executive power, while Biden’s signature appeared on thousands of documents that led to significant policy changes.

For years, President Biden experienced significant cognitive decline. In fact, the Department of Justice concluded that there was sufficient evidence of legal violations, yet Biden was deemed unfit for trial due to his mental state. Reports suggest that his cognitive challenges were even more pronounced in private, with close associates reportedly attempting to conceal these issues from the public eye. To achieve this, Biden’s advisors limited his media interactions and scripted his discussions with lawmakers and donors to cover up his diminishing capacity to fulfill his duties.

Despite these serious concerns, the White House managed to issue over 1,200 Presidential documents, appoint 235 judges to federal benches, and grant more pardons and commutations than any prior administration. Notably, just two days before Christmas in 2024, Biden commuted the sentences of 37 of the 40 most heinous criminals on federal death row, including several individuals convicted of child murder and mass killings.

While the President possesses constitutional authority to execute these actions, questions arise regarding the decision-making process and the extent of Biden’s awareness of these actions taken in his name. Reports indicate that a significant number of Biden’s executive actions were signed with a mechanical pen, or autopen, particularly during the latter part of his presidency when his cognitive decline became increasingly evident to those around him.

Given the apparent signs that President Biden lacked the mental capacity to exercise his authority, if his advisors did indeed use the mechanical signature pen to obscure this incapacity while executing radical actions in his name, it could represent an unconstitutional exercise of Presidential power. Such a scenario would raise serious legal questions regarding the legitimacy of numerous executive actions undertaken during Biden’s tenure.

Sec. 2. Investigation. (a) The Counsel to the President, in collaboration with the Attorney General and relevant agency heads, shall conduct an investigation, as permitted by law, to determine if certain individuals conspired to mislead the public regarding Biden’s mental state and unlawfully exercised Presidential authority. This investigation will focus on:

(i) any coordinated activities aimed at concealing the truth about Biden’s mental and physical health;

(ii) any agreements among Biden’s aides to falsely label recorded videos showcasing the President’s cognitive challenges as fabricated;

(iii) any collusion among aides to produce misleading public statements regarding the President’s capabilities; and

(iv) the underlying motivations for these actions, particularly in asserting Presidential authority.

(b) Furthermore, the Counsel to the President shall investigate, in conjunction with the Attorney General and relevant agency heads, the circumstances surrounding Biden’s purported execution of various executive actions during his final years. This examination will cover:

(i) the policy documents for which the autopen was utilized, including clemency grants, Executive Orders, Presidential memoranda, or other significant policy decisions; and

(ii) who directed the affixing of the President’s signature to these documents.

Sec. 3. General Provisions. This memorandum does not create any rights or benefits, whether substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other individual.
