In a dramatic turn of events, former President Donald Trump has initiated an investigation to ascertain whether members of the Biden administration improperly wielded presidential powers through the use of an autopen—a mechanical device that mimics the president’s signature—without explicit approval from President Joe Biden himself.
A memorandum dated June 4, issued by Trump, mandates a review of whether certain individuals “colluded to mislead the public regarding Biden’s mental faculties and unlawfully exercised presidential powers.” This document highlights Trump’s allegations of a conspiracy that purportedly exploits Biden’s cognitive challenges.
In this memorandum, Trump states, “In recent months, it has become increasingly evident that aides to former President Biden have misused the authority of the presidential signature via autopen to obscure Biden’s cognitive decline and project Article II authority.”
Trump characterizes this situation as “one of the most perilous and alarming scandals in American political history,” accusing Biden’s administration of intentionally obscuring the true nature of executive power while deploying his signature on thousands of documents to enact significant policy changes.
The Department of Justice is tasked with determining whether Biden had any intention of authorizing the autopen for signing official documents during his presidency. This inquiry could potentially provide Republicans with a legal basis to challenge the validity of Biden’s executive actions if evidence suggests he was not involved in crucial decisions.
A fact sheet released by the White House references longstanding concerns about Biden’s mental acuity throughout his presidency, stating, “Reports indicate that Biden has faced serious cognitive decline for years.”
It also points to the findings of Special Counsel Robert Hur, whose investigation into Biden’s alleged mishandling of classified documents did not proceed, partly due to Hur’s conclusion that Biden’s mental state would prevent him from standing trial.
The White House elaborated, “Although the Department of Justice determined that Biden unlawfully retained and disclosed classified materials, it ultimately decided that he was unfit for trial due to his mental incompetence.”
Moreover, the memorandum criticizes Biden’s advisers for allegedly restricting his public engagements and closely scripting his interactions with lawmakers, officials, and donors. The investigation is set to delve into whether the autopen has been misused unlawfully.
“The combination of Biden’s documented cognitive decline and the frequent use of an autopen raises significant questions about the legitimacy of his actions,” the fact sheet asserts, claiming that over 1,200 presidential documents have been signed with an autopen during his term, which includes the appointments of 235 federal judges and an unprecedented number of pardons and commutations.
According to a 2005 ruling by the Justice Department, a verbal or implied directive from the president can legally permit a subordinate to utilize an autopen to sign documents on behalf of the president, as long as it reflects the president’s intent.
