Federal Prosecutor Resigns Following Indictment of MS-13 Member

In a dramatic turn of events, a high-ranking federal prosecutor has stepped down in protest after a grand jury brought charges against Kilmar Abrego Garcia, an alleged member of the notorious MS-13 gang, for trafficking undocumented migrants.

Kilmar Abrego Garcia, a national from El Salvador, had been living illegally in Maryland. In 2019, an immigration judge ordered his removal from the United States due to his gang affiliations. However, after a lengthy legal battle regarding his deportation, he was repatriated from El Salvador to face serious criminal charges.

Initially, Abrego Garcia was held in El Salvador’s infamous CECOT prison, but he was recently transferred to a lower-security facility in San Salvador.

Charges and Allegations

A federal grand jury in Tennessee indicted Garcia on charges of “transporting undocumented migrants within the United States.” Specifically, he faces a conspiracy charge for the transportation of aliens and an additional count for unlawfully transporting undocumented individuals.

The indictment reveals that Garcia, in collaboration with co-conspirators from El Salvador, Guatemala, Mexico, and the U.S., was engaged in human trafficking activities from 2016 to 2025.

“If convicted at trial, the defendant could face up to 10 years in prison for each undocumented individual he transported,” stated government officials. Furthermore, reports surfaced that a co-conspirator disclosed Garcia’s involvement in the murder of a rival gang member’s mother, adding another layer of severity to his already grave charges.

Resignation Sparks Controversy

In a surprising fallout from the indictment, Ben Schrader, the Chief of the Criminal Division at the U.S. Attorney’s Office for the Middle District of Tennessee, announced his resignation. Schrader expressed concerns that the prosecution of Abrego Garcia was politically motivated.

“Earlier today, after nearly 15 years as an Assistant United States Attorney, I resigned as Chief of the Criminal Division at the U.S. Attorney’s Office for the Middle District of Tennessee. It has been an incredible privilege to serve as a prosecutor with the Department of Justice, where the only job description I’ve ever known is to do the right thing, in the right way, for the right reasons. I wish all of my colleagues at the U.S. Attorney’s Office in Nashville and across the Department the best as they seek to do justice on behalf of the American people,” Schrader wrote on LinkedIn.

Official Statements and Future Actions

Pam Bondi, a prominent figure in this case, held a press conference regarding Garcia’s indictment, asserting that he will eventually be returned to El Salvador.

In a tweet that stirred the pot, Bondi noted, “#BREAKING: Pam Bondi officially announces Kilmar Abrego Garcia will be returned to the US after the DOJ uncovered he made OVER 100 SMUGGLING TRIPS of illegals.” The gravity of the situation was underscored by claims that a grand jury found human trafficking to be Garcia’s full-time occupation, coupled with allegations of abuse against women.
