Chicago’s plan to replace its lead service lines by 2076 has come under scrutiny for being too slow and potentially putting residents at risk of lead exposure. The city, known for having the most lead service lines in the country, has been urged by advocates to speed up the process to comply with new federal regulations.

Chakena D. Perry, a senior policy advocate for the Natural Resources Defense Council, grew up in Chicago knowing not to trust the water from her tap due to the prevalence of lead pipes in the city. Last year, the Biden administration’s EPA mandated that water systems replace all their lead service lines, with most systems given 10 years to complete replacements. However, Chicago’s plan, submitted to the Illinois Environmental Protection Agency, puts the city 30 years behind that timeline.

The city’s plan aims to replace an estimated 412,000 lead service lines by 2076, starting in 2027. This timeline is significantly slower than the new federal rule, which requires Chicago to replace nearly 20,000 pipes per year starting in 2027. The delayed timeline could expose more children and adults to the risks of toxic drinking water, especially with the potential for lead to leach off pipes due to rising temperatures from climate change.

Lead exposure can have severe health effects, particularly on children, causing brain and nervous system damage, kidney issues, and reproductive health problems. Lead exposure during pregnancy can also lead to low birth weight or preterm birth. Experts emphasize that there is no safe level of lead exposure, making the replacement of lead service lines a critical public health issue.

In Illinois, people of color are disproportionately affected by lead service lines, with communities burdened by lead pipes facing higher risks of exposure. With the three-year grace period provided by the 2024 EPA rule, Chicago does not have to begin compliance until 2027, but the city’s current plan is slower than necessary to meet the new requirements.

Advocates and experts are calling for Chicago to accelerate its lead service line replacement plan to protect residents from the dangers of lead exposure. The city will need to significantly increase the pace of replacements to ensure the safety of its water supply and the health of its residents. Chicago is making progress in replacing lead service lines, with about 60 percent of replacements occurring alongside repairs for breaks and leaks or water and sewer main replacements. Megan Vidis, a spokesperson for the Chicago Department of Water Management, stated that the city is increasing its replacement speeds and aims to replace 8,000 lines this year.

Vidis emphasized the city’s commitment to replacing lead service lines as quickly as resources allow. However, she acknowledged the challenges posed by the city’s split ownership structure, where homeowners own part of the line and the city owns the other. This ownership structure requires substantial additional funding, particularly for private side replacements.

Erik D. Olson, senior strategic director for environmental health at the NRDC, highlighted the financial challenges facing Chicago and urged the city to pursue a more ambitious replacement plan. He pointed out that $15 billion in national lead service line replacement funds from the Infrastructure Investment and Jobs Act are set to expire next year. Olson emphasized the importance of Chicago securing this funding to accelerate the replacement of lead service lines.

The EPA confirmed that Illinois water systems are currently under the new lead service line replacement rule. Illinois EPA spokesperson Kim Biggs stated that the state is operating under the replacement requirements outlined in the 2021 EPA rule and state law until 2027.

Lead service lines have been a long-standing issue in Chicago, influenced by the city’s municipal code and historical ties to lead companies and the plumbers union. A study published last year found that two-thirds of young children in Chicago live in homes with tap water containing detectable levels of lead. Chicago’s lead service line replacement plan is based on a 2021 state law that requires water systems with 100,000 or more lead service lines to replace all of them within 50 years from 2027. This law was considered stronger than the federal Lead and Copper Rule Revisions of 2021, which did not mandate replacement in most cases. The EPA’s current rule requires most systems to replace all lead service lines by 2038, with deferral allowances for places with a large proportion of lead service lines.

Despite these efforts, Chicago’s plan has yet to fully align with the newer federal law. The city faces challenges in securing funding and coordinating replacements, but the urgency of addressing lead service lines to protect residents’ health remains a top priority. As Chicago continues its lead service line replacement efforts, it must navigate financial constraints and regulatory requirements to ensure safe drinking water for all residents. Chicago’s plan to replace lead service lines is facing challenges as the city grapples with compliance timelines and funding issues. The city acknowledges the faster federal timeline but has not yet fully committed to abiding by it. Chicago’s water department cited ongoing litigation as a reason for not accounting for the 20-year replacement timeline in its plan. Despite the lawsuit, the rule remains in effect, and compliance dates have not changed. Each service line replacement in Chicago averages around $35,000, significantly higher than national estimates. Lowering these costs by replacing service lines for full blocks at a time is a proposed strategy.

Securing funding for lead service line replacement poses a significant challenge for Chicago, especially with potential cuts to federal funding. The Trump administration’s budget proposal includes cutting the EPA’s budget by more than half, including funding for low-interest loan programs for water infrastructure updates. The loss of $2 million in funding for a program focused on replacing lead service lines in daycares serving low-income communities further complicates the situation.

Megan Glover, co-founder of 120Water, expressed concerns about federal funding for water infrastructure projects. With grants and earmarks up for grabs under the new administration, uncertainty surrounds funding for lead service line replacement programs. Anna-Lisa Gonzales Castle, director of water policy at Elevate, emphasized the need for swift action from the city, federal government, and state to address lead service line replacement. She called for an all-hands-on-deck approach to ensure homeowners are not left responsible for a problem that wasn’t their fault.
