Federal Judge Blocks Big Beautiful Bill From Defunding Planned Parenthood

In a significant legal development, US District Judge Indira Talwani has granted a temporary restraining order that halts the attempted defunding of Planned Parenthood, a move embedded in Trump’s aptly named “Big Beautiful Bill.”

Judge Talwani stated:

Upon reviewing the Plaintiffs’ Emergency Motion for a Temporary Restraining Order and Preliminary Injunction [Doc. No. 4] along with the supporting documents, I find sufficient justification for the request, and thus it is ORDERED that the request for a Temporary Restraining Order is GRANTED.

It is further ORDERED that:

1. Defendants, along with their agents, employees, appointees, successors, and anyone collaborating or acting in concert with them, are hereby prohibited from enforcing, retroactively enforcing, or applying the provisions of Section 71113 of “An Act to provide for reconciliation pursuant to title II of H. Con. Res. 14,” against Planned Parenthood Federation of America and its affiliates; Planned Parenthood League of Massachusetts; and Planned Parenthood Association of Utah;

2. Defendants, their agents, employees, appointees, successors, and anyone collaborating with them must take all necessary actions to guarantee that Medicaid funding continues to be disbursed in the usual manner and timelines to Planned Parenthood Federation of America and its affiliates; Planned Parenthood League of Massachusetts; and Planned Parenthood Association of Utah.

3. Plaintiffs shall promptly serve this Temporary Restraining Order on Defendants electronically or by an alternative method permitted by Fed. R. Civ. P. 5(b)(2). Within 72 hours of such service, Defendants shall provide a copy of this Temporary Restraining Order to all personnel in the Department of Health and Human Services and all state agencies involved in Medicaid funding disbursement.

4. Defendants are required to file a status report with the Court confirming compliance within 96 hours of the service of this order. This Temporary Restraining Order will remain in effect for fourteen days unless vacated, modified, or extended by the court.

IT IS SO ORDERED.

The Republican initiative aimed to defund Planned Parenthood by prohibiting Medicaid patients from accessing healthcare services at these facilities. It’s noteworthy that abortion care is already excluded from Medicaid, which begs the question: what exactly are Republicans defunding under the guise of “life”? The answer appears to be essential healthcare services for women.

Targeting a single provider with such legislation raises serious legal concerns, and this restraining order could represent a crucial first step in ensuring that Planned Parenthood can continue to deliver necessary services to women.
