Former Labor Lawyer Sues Netflix for Racial Discrimination and Sexual Harassment

A former labor lawyer at Netflix has filed a lawsuit against the streaming giant, alleging that she was wrongfully terminated after raising concerns about racial discrimination and sexual harassment within the company. Nhu-y Phan, who previously held positions at the Directors Guild of America and IATSE Local 600, joined Netflix in 2021 with a salary of $400,000 per year.

Phan claims that she and other women of color at Netflix were denied opportunities that were offered to white male colleagues. She raised issues with her supervisor, Ted Sinclair, stating that he exhibited microaggressions and micromanagement towards her. Despite her complaints, Phan alleges that she was excluded from important negotiations and was not given choice assignments.

After requesting a reassignment to a different supervisor, Phan continued to face challenges in her role. She voiced her concerns to HR about the lack of inclusivity in the workplace, highlighting the discrepancies in treatment between white employees and employees of color. Despite her efforts to address these issues, Sinclair was promoted within the company.

Phan also reported an incident of sexual harassment involving her new supervisor inviting a co-worker to social outings. In 2024, Phan received feedback on her communication skills and was later terminated for alleged performance issues following a department reshuffle.

The lawsuit filed by Phan emphasizes the emotional and financial toll of her termination, stating that she has struggled to find comparable employment and has suffered damage to her reputation. Netflix has not yet responded to requests for comment on the matter.
