Former Cook County Correctional Officer Cleared of Charges in Inmate Assault Case

All charges have been dropped against Richard Smith, a former Cook County correctional officer accused of assaulting a restrained inmate inside the jail nearly three years ago. Smith, 44, was facing charges of aggravated battery and official misconduct for the September 2022 incident, where he allegedly punched the inmate more than 30 times in the head and torso. The charges were dismissed without explanation during a hearing that was supposed to be the first day of Smith’s trial.

During the hearing, Judge Laura Ayala-Gonzalez asked Smith if he agreed that the dismissal was the best resolution, to which Smith replied in the affirmative.

The Cook County State’s Attorney’s Office stated that they were unable to meet the burden of proof in the case, leading to the dismissal of charges. They emphasized their responsibility to continuously evaluate evidence and determine the feasibility of prosecution.

The incident in question occurred when Smith and another officer restrained a 24-year-old detainee outside the jail’s medical unit. The detainee allegedly spat on Smith, prompting Smith to respond with multiple punches to the detainee’s face and torso. Surveillance video captured the altercation, leading to Smith’s removal from duty and subsequent termination earlier this year.

The Cook County Sheriff’s Office stated that they do not tolerate excessive force or officer misconduct, leading to Smith’s swift termination following the incident. Smith’s attorney, Dan Herbert, did not provide comment for this story.
