In a recent article, New York Times technology columnist Kevin Roose highlighted the unpreparedness of most people and institutions to handle the capabilities of AI systems, including the potential dangers they pose.

Roose’s concerns are not unfounded, as evidenced by a recent federal lawsuit filed against OpenAI seeking a temporary restraining order to prevent the deployment of its products, such as ChatGPT, in Hawaii. The lawsuit aims to address the lack of safety measures in place for AI systems, a sentiment echoed by AI development leaders, including OpenAI’s CEO Sam Altman.

Altman, along with over 1,000 technology leaders, signed an open letter emphasizing the need to prioritize AI safety as a global priority. Despite these calls for action, efforts to regulate AI at the state and federal levels have been met with challenges and setbacks, leaving Hawaii vulnerable to the potential risks of unregulated AI deployment.

OpenAI, once committed to safety measures such as dedicating resources to safety research and prohibiting military applications, has since backtracked on these commitments. The company’s governance structure has been altered, critical safety researchers have left, and guardrails against misinformation and disinformation have been eliminated, raising concerns about the company’s prioritization of safety over commercial interests.

The federal lawsuit against OpenAI makes four key claims related to product liability, failure to warn, negligent design, and public nuisance. These claims highlight the need for AI companies to prioritize safety measures and adhere to established safety standards to protect public interests.

While the lawsuit focuses on Hawaii, its implications extend beyond state borders, emphasizing the need for regulatory oversight and safety measures in AI development and deployment. As the world grapples with the transformative impact of AI technology, it is essential to proceed with caution and prioritize safety measures to protect against potential risks. The lawsuit against OpenAI serves as a call to action to restore sanity in AI development and deployment and ensure that ethical considerations are at the forefront of technological advancements.
