California’s State Senate recently passed a new AI safety bill, SB 53, which is now awaiting Governor Gavin Newsom’s decision to either sign it into law or veto it. This bill, introduced by State Senator Scott Wiener, focuses specifically on regulating big AI companies that generate more than $500 million in annual revenue.

Last year, Governor Newsom vetoed a similar AI safety bill, SB 1047, which faced pushback due to its broad scope. However, SB 53 is more targeted and has received support from AI company Anthropic. In a discussion on JS’s Equity podcast, colleagues Max Zeff and Kirsten Korosec highlighted the significance of this legislation.

Max emphasized the importance of AI safety regulations as a necessary check on the power of tech companies, especially as AI becomes increasingly prevalent. SB 53 mandates that AI labs publish safety reports for their models, report any incidents to the government, and provide a channel for employees to voice concerns without facing repercussions.

Kirsten pointed out that California is a hub for AI activity, making it crucial for the state to implement regulations. While SB 53 is narrower in scope compared to its predecessor, it includes exemptions for small startups to avoid hindering the startup ecosystem, which is vital to California’s economy.

The bill specifically targets larger AI developers like OpenAI and Google DeepMind, requiring them to disclose more safety information compared to smaller startups. This tailored approach aims to strike a balance between regulating AI companies and fostering innovation in the industry.

With the changing landscape of AI regulation at the federal level, where there is a push for minimal regulation, state-level initiatives like SB 53 become even more significant. The potential clash between state regulations and federal policies underscores the importance of state governments taking proactive steps to address AI safety concerns.
