President’s Executive Order on Duty-Free Treatment
As President of the United States, I am taking action to address the situation at our southern border. By invoking the International Emergency Economic Powers Act, the National Emergencies Act, and other relevant statutes, I hereby make the following determination and order:
Section 1: Amendment to Executive Order
Executive Order 14194, issued on February 1, 2025, and amended by Executive Order 14198 on February 3, 2025, is further revised. Section 2(g) of the order is updated to ensure that duty-free de minimis treatment under 19 U.S.C. 1321 is available for eligible covered articles. This treatment will cease upon confirmation from the Secretary of Commerce that adequate systems are in place to collect tariff revenue for these articles.
Section 2: General Provisions
(a) This order does not limit the authority of executive departments, agencies, or their heads, nor does it impact the functions of the Director of the Office of Management and Budget.
(b) Implementation of this order will adhere to applicable law and funding availability.
(c) This order does not confer any new rights or benefits that can be enforced against the United States or its entities.
