Federal Appeals Court Rules Trump’s Order to End Birthright Citizenship Unconstitutional
WASHINGTON (AP) — In a significant decision, a federal appeals court ruled Wednesday that President Donald Trump’s order to end birthright citizenship is unconstitutional. This ruling affirms a previous decision by a lower court that had blocked the enforcement of the order nationwide.
This ruling from a divided panel of the 9th U.S. Circuit Court of Appeals is a major setback for the Trump administration’s immigration policies. It follows a similar decision by a federal judge in New Hampshire, bringing the issue closer to a potential review by the Supreme Court.
The 9th Circuit has effectively halted the enforcement of Trump’s order, which aimed to deny citizenship to children born to parents who are in the United States illegally or temporarily.
“The district court correctly concluded that the Executive Order’s proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional. We fully agree,” the majority opinion stated.
