The legal battle over the mail distribution of the abortion pill, mifepristone, continues in the United States. Earlier this year, a federal appeals court mandated that mifepristone be dispensed only in person at clinics. However, the Supreme Court has temporarily reinstated mail access in states where abortion via medication is legal, though its long-term availability remains uncertain.

Acting Attorney General Todd Blanche is determined to halt the mailing of abortion medications. Sen. Josh Hawley (R-Mo.) has urged Blanche to initiate a criminal investigation into the nonprofit Plan C and Danco Laboratories, the pill’s manufacturer.

Recently, a federal judge in Virginia confirmed mifepristone’s safety and instructed the Trump administration to revisit the drug’s restrictions. Meanwhile, the U.S. Court of Appeals for the Fifth Circuit plans to hear arguments concerning a Louisiana case seeking to ban telemedicine prescriptions and mail delivery of mifepristone. In a related action, attorneys general from Louisiana, Idaho, and Missouri filed a lawsuit in October 2025 to prohibit telehealth abortions and pharmacy distribution of the pill across the nation.

One potential outcome of these legal proceedings might be the reinstatement of in-person dispensing requirements, forcing patients to obtain mifepristone directly from clinics rather than through pharmacies or mail.

Despite these court debates, the Food and Drug Administration (FDA) is conducting a retrospective analysis of real-world data on mifepristone’s safety. Reproductive rights advocates and medical researchers criticize this review, calling it politically driven, as the drug has been proven safe and effective through decades of data.

Since its approval by the FDA over 25 years ago, mifepristone, along with misoprostol, has been used to end early pregnancies up to 10 weeks post-fertilization. This two-drug regimen is considered safe and effective by public health experts, with serious complications occurring in less than 1% of cases.

In the U.S., nearly two-thirds of people seeking abortions opt for medication over surgical procedures. Since 2021, telemedicine has facilitated access to abortion medication, with approximately 28% of all abortions now conducted this way.

Despite stringent restrictions or near-total bans in 13 states, the total number of abortions in the U.S. has slightly increased following the Supreme Court’s 2022 Dobbs decision, which overturned Roe v. Wade and returned abortion regulation to individual states. This rise is largely due to expanded telehealth access, mail-order medications, and interstate travel to states with legal abortion services.

Nationally, while the number of abortions has risen, access remains inconsistent. States with near-total bans have seen local numbers plummet, while those with legal abortion options have experienced significant increases in patient numbers.

The mifepristone controversy is emblematic of the broader political and judicial debates surrounding abortion in the U.S. Despite more than 20 years of safe usage, mifepristone remains a contentious issue. The U.S. stands out among wealthy nations for its politicized approach to abortion, whereas other countries treat it primarily as a public health issue. The World Health Organization lists mifepristone among approximately 500 essential medicines.

The Supreme Court has maintained access to mifepristone while Louisiana’s challenge progresses through the courts. Although this decision provides temporary relief, ongoing threats to mifepristone’s availability and the FDA’s regulatory authority persist.

The FDA is tasked with evaluating the safety and efficacy of drugs based on clinical evidence, asserting its role as the federal authority over all pharmaceuticals distributed in the U.S., including mifepristone and misoprostol.

These legal challenges and calls for further regulatory review could undermine the FDA’s authority, experts caution. If courts begin to overturn FDA decisions, it could greatly disrupt the pharmaceutical regulatory landscape.
