The Boise State women’s volleyball team made headlines recently when they announced they would be forfeiting their opportunity to play in the Mountain West Conference semifinals against San Jose State. The reason behind this decision was not explicitly stated by the team, but it is widely believed to be due to the presence of Blaire Fleming, a biological male, on the San Jose State team.

This is not the first time Boise State has had to forfeit a match against San Jose State this season, as this marks the third instance of such an occurrence. Two players from Boise State have taken legal action by joining a lawsuit against the Mountain West, alleging that allowing Fleming to play violates Title IX and their First and 14th Amendment rights.

According to reports from the Idaho Statesman and Fox News, the lawsuit specifically targets the Mountain West Commissioner Gloria Nevarez and four San Jose State officials. The lawsuit claims violations of Title IX and the players’ constitutional rights in light of Fleming’s participation on the San Jose State team.

The controversy surrounding Fleming’s participation in women’s volleyball matches has been ongoing, with concerns raised about safety and fairness. In a match between San Jose State and San Diego State, Fleming’s powerful spike struck an opponent in the face, resulting in immediate injury and a concerning incident that has sparked further debate.

Fleming, a redshirt senior, has been at the center of multiple colleges forfeiting matches against San Jose State this season due to safety concerns. The issue of transgender athletes competing in women’s sports has been a topic of intense discussion and debate, with instances like the tragic case of Payton McNabb, a high school volleyball player who suffered severe injuries after being struck by a spiked ball from a trans player back in September 2022.

McNabb’s injuries included neurological impairments such as a concussion, vision problems, and partial paralysis to the right side of her body. Despite being a student at Western Carolina University now, McNabb continues to struggle with the lasting effects of the incident, highlighting the complex and serious nature of safety concerns in women’s sports.

The decision by Boise State to forfeit their match against San Jose State underscores the ongoing challenges and controversies surrounding transgender athletes in women’s sports. As discussions and legal actions continue, the debate over fairness, safety, and inclusivity in sports remains a prominent issue that will likely shape the future of competitive athletics.
