Earlier this week, during his testimony to the Senate’s Health, Education, Labor, and Pensions Committee, Robert F. Kennedy Jr. was asked a straightforward question by Lisa Blunt Rochester: “Who is the acting CDC director?” Kennedy responded with the name “Matt Buzzelli,” describing him as a “public health expert.”

However, despite Kennedy’s assertion, there are lingering doubts about whether the Centers for Disease Control and Prevention (CDC) indeed has an acting director at this moment. The CDC website does not list one, and CDC staff members have not been informed that Buzzelli is serving as the acting director. Furthermore, the HHS communications office has evaded questions regarding the appointment of Buzzelli as the acting director.

On the CDC’s leadership webpage, Matthew Buzzelli is listed as the agency’s chief of staff, ranking fourth. Debra Houry, the deputy director for program and science and the chief medical officer, is positioned at the top. Susan Monarez, a career civil servant with a biosecurity background, was initially appointed as the acting director in March. However, she is now President Trump’s nominee for the director position and is awaiting Senate confirmation.

When asked about the acting director of the CDC, Andrew Nixon, the HHS director of communications, stated that Matt Buzzelli is currently running the agency. However, Nixon did not confirm whether Buzzelli has officially been named as the acting director. The ambiguity surrounding Buzzelli’s eligibility for the role has raised concerns among experts.

Under the Vacancies Act, the default person to serve as an acting director should be the “first assistant,” but the act does not specify who that individual is. It also outlines criteria for an acting director, including being a Senate-confirmed government employee or an officer from the same agency who has worked there for at least 90 days before the vacancy occurred. Buzzelli’s appointment as CDC chief of staff in mid-February raises questions about his eligibility based on the 90-day requirement.

Richard Hughes, a lawyer specializing in vaccine policy, noted that there is room for interpretation in the statute regarding the designation of an acting director. The timeline for appointing a permanent CDC director remains uncertain, as a confirmation hearing for Susan Monarez has not been scheduled yet. The HELP committee requires all necessary paperwork and an Office of Government Ethics review before setting a hearing date.
