The father of Elijah McClain, Lawayne Mosley, 54, was sentenced to 10 days in jail or home detention and received a 12-month deferred sentence for assaulting a Colorado State Patrol trooper during a drunken-driving arrest, as reported by the Arapahoe County District Attorney’s Office. Mosley pleaded guilty to felony second-degree assault on a police officer and DUI in August and was sentenced in Arapahoe County District Court on Monday.
He was given a 10-day jail sentence with credit for one day served, which can be served on home detention. Additionally, Mosley was sentenced to 12 months of probation for the DUI charge.
The incident occurred on January 20 when Mosley was stopped by a trooper on Interstate 70 after another driver reported his erratic driving behavior. Mosley resisted the trooper’s orders and assaulted the officer during the altercation.
Mosley identified himself as Elijah McClain’s father during the arrest. McClain tragically passed away in 2019 after being wrongfully arrested by Aurora police officers and administered a fatal dose of ketamine by paramedics.
Following McClain’s death, three first responders were convicted, and reforms were implemented in the Aurora Police Department regarding ketamine use in police encounters. The city of Aurora also settled a civil rights lawsuit with McClain’s parents for $15 million.
An attorney for Mosley has not provided any comments on the sentencing.
