Adriana Smith, a Georgia woman who was declared brain-dead and kept on life support due to her pregnancy, has finally been taken off life support after giving birth last week, according to her family’s statement to NBC affiliate 11 Alive.

This tragic case underscores the impact of Georgia’s stringent abortion ban, which prohibits most abortions once fetal cardiac activity is detected, usually around six weeks into pregnancy. Despite being declared brain dead in February, 31-year-old nurse Adriana Smith was kept on life support because of concerns about violating the state’s law, as reported by AP News.

Emory University Hospital, where Smith was being cared for, explained that their decisions were based on medical expertise, legal considerations, and compliance with Georgia’s laws, including those concerning abortion.

Newkirk, along with reproductive rights advocates and lawmakers, have condemned the treatment of Smith, emphasizing the lack of autonomy her family had in making decisions regarding her care. “We should have had a choice in this matter,” Newkirk expressed in a statement.

Nourbese Flint, president of All* Above All, a reproductive rights advocacy group, criticized the dehumanization of Smith and the infringement on her family’s rights by anti-abortion policies. “Anti-abortion politicians took away their right to decide on a personal and medical matter,” Flint told JS.

Smith’s baby, named Chance, was delivered prematurely via Cesarean section, weighing only 1 pound and 13 ounces. He is currently receiving care in the neonatal intensive care unit at Emory, Newkirk mentioned.

The case of Adriana Smith has shed light on the uncertainties and negative impacts brought about by strict abortion bans. Georgia’s LIFE Act, signed into law in 2019 but enforced post the overturning of Roe v. Wade in 2022, has created confusion regarding medical decision-making in such scenarios. While Georgia’s Attorney General Chris Carr clarified that the law does not forbid removing someone from life support, State Sen. Ed Setzler, the bill’s sponsor, as per NBC News.

The legal ambiguity surrounding abortion bans has put healthcare providers in challenging positions, as seen in the case of Amber Nicole Thurman, who tragically lost her life in Georgia due to delayed medical intervention, ProPublica highlighted.

Amidst these challenges, advocates like April Newkirk stress the importance of upholding women’s autonomy over their bodies. “All women deserve the right to choose,” Newkirk emphasized.
