Insurer Denies Access To Drugs Granted Accelerated Approval By FDA

Health insurers have recently come under scrutiny for their decision to reject coverage of prescription drugs licensed under the FDA’s accelerated approval program. One such insurer, Independence Blue Cross, announced a new policy that prohibits coverage of FDA-approved treatments until 18 months after accelerated approval.

The FDA’s accelerated approval program, established in 1992 during the HIV/AIDS epidemic, aims to expedite the licensing of drugs for serious or life-threatening conditions. This program allows the FDA to approve drugs based on surrogate endpoints that are “reasonably likely to be associated with clinical benefits,” with the requirement for manufacturers to conduct confirmatory post-approval clinical trials.

Independence Blue Cross’s new policy excludes coverage of drugs, biologics, cell, and gene therapies that have received accelerated approval based on a surrogate endpoint. While this policy went into effect on January 1, 2025, it does not apply to drugs used to treat cancer or those mandated by federal or state regulations.

A spokesperson for Independence Blue Cross stated that the exclusion applies to a “small number of drugs and therapies” where there is a lack of acknowledged clinical benefit. The insurer aims to ensure that members receive treatments proven to be safe and effective.

While this policy has garnered attention, it is not unique in the industry. Many payers, including those in the commercial and Medicare sectors, have the authority to restrict coverage of drugs granted accelerated approval if they deem the clinical trial evidence insufficient.

Recent reports from the Health and Human Services Office of Inspector General have raised concerns about certain accelerated approvals, citing issues with delayed or incomplete confirmatory trials for some drugs. In particular, drugs like Aduhelm have faced controversy for their regulatory approval process, with the FDA overruling advisory committee recommendations.
