A Jan. 6 defendant has requested a delay in his case following Donald Trump’s projected victory in the presidential race, citing Trump’s promises of clemency to nonviolent offenders. Christopher Carnell and David Worth Bowman, both from North Carolina, were involved in the Capitol riot on Jan. 6, 2021. Carnell, who was 18 at the time, entered the Capitol and interacted with other rioters, even commenting that Sen. Ted Cruz was “on our side.”

Carnell is scheduled for a status hearing on Nov. 8 but has asked for it to be postponed to Dec. 13 to await potential clemency actions from the Office of the President-elect. His attorney filed a request with the federal court in Washington, D.C., seeking a later hearing date.
