Kim Zolciak is battling to avoid being deposed in another couple’s divorce case—unrelated to her own separation from Kroy Biermann—with significant financial stakes at play.
The television personality has filed a motion to block a subpoena in the divorce of Jillian Green and Kyle Mowitz, claiming the notice she received in a parking lot was “unreasonable, oppressive and intended to annoy and embarrass her.” Her legal team believes the court should deny the request, according to Us Weekly.
An affidavit from the process server indicates that Kim was served papers on Saturday, September 20 just after 7 PM in the parking area of her son’s school before a football game.
The process server reported that they drove up behind Kim’s vehicle and called out her name. Upon her turning around, they handed over the documents and departed.
The relation between Zolciak and the divorce case remains unclear. Us Weekly notes that Green requested “any and all documents related to your financial relationship with Kyle Mowitz, including gifts exchanged, expenses covered by Mr. Mowitz, loans, and payments received from him or related businesses.”
Kim mentions that she was previously negotiating with Green’s lawyer to avoid a public issue and sought a confidentiality agreement to provide necessary information due to her celebrity status attracting significant media coverage. The deposition was set for today, October 15.
Zolciak claims that talks broke down when Green’s legal team deemed her requests “too restrictive and complicated.” She asserts that the next communication she received was the subpoena served at her son’s school last month.

Kim is quite unhappy about the manner in which she was served, with her legal team criticizing the process for being public—in full view of her son, his friends, and their parents—despite her initial willingness to cooperate with their requests.
As for the financial implications of this divorce, Us Weekly reveals that Green previously stated in legal documents that there is $100 million in a trust between her and her estranged spouse, making it a serious matter beyond mere pocket change.
