A brewing company in Oamaru finds itself in the midst of a legal battle as the owner, Phillip Scott, is facing allegations of unjustly dismissing his wife, Tyla, from her role in the business following their separation. The Employment Relations Authority is currently investigating the matter, with an interim decision being released recently.

Scott’s Brewing Ltd is primarily managed by Phillip Scott, who holds a majority share in the company, while his wife owned a smaller stake. The couple initially ran the business together, but Tyla Scott was removed as a director in 2014, a move she claims was based on accounting advice.

The situation escalated last year when the couple separated, prompting the company’s chief executive to request that they both step back from their roles due to the impact of their personal issues on the business. While Tyla Scott’s lawyer sought to resume her involvement in the company, she was ultimately informed that her position was no longer required.

Tensions rose as Tyla Scott believed her dismissal was a ploy by her husband to remove her from the business amid their ongoing property division proceedings. The company, however, maintained that the decision was made in good faith and based on operational needs.

The Authority member presiding over the case acknowledged the complexity of the situation, noting the intertwined personal and professional dynamics at play. While Tyla Scott was temporarily reinstated on the payroll, further investigations were deemed necessary to determine the validity of her claims and the extent of her involvement in the company.

The ongoing legal battle sheds light on the challenges faced by couples in business together, particularly in cases of separation and conflict of interest. The outcome of the investigation will likely have significant implications for both parties involved.
