The controversy surrounding the start-up iyO, OpenAI, and former Apple design chief Sir Jony Ive has taken a new turn as iyO’s CEO, Jason Rugolo, accuses the larger companies of trying to “bury” his firm after discussions of a potential collaboration. Rugolo claims that he was blindsided by the launch of io, OpenAI’s partnership with Ive, which led to the removal of marketing materials about their $6.4bn AI device venture.

The trademark dispute arose after OpenAI revealed plans to acquire Ive’s hardware start-up, io, as an alternative to smartphones for accessing AI. Rugolo had pitched iyO to OpenAI CEO Sam Altman in March, with discussions about potentially bringing iyO into OpenAI and launching the iyO ONE as an OpenAI product. However, after the io deal was announced, Rugolo felt vulnerable and exposed, questioning the motives behind the partnership.

In a lawsuit filed by iyO, details of meetings between Rugolo, OpenAI, and Ive’s team leading up to the launch were disclosed. Rugolo claims that discussions included potential acquisition talks, with members of OpenAI and io trying out the iyO device and showing interest in the company. However, Altman and Tan denied any intentional trademark infringement, stating that iyO’s product did not meet their standards and that they were not aware of Rugolo or his company until recently.

The court case is set for trial in January 2028, with a preliminary injunction hearing in October to determine the future of products carrying the io brand. Rugolo maintains that the io announcement has impacted his start-up’s fundraising efforts and that the larger companies are trying to suppress competition. OpenAI, Altman, and Ive argue that the lawsuit is premature as io is still a year away from offering any goods or services, and their product is different from what iyO is offering.
