NAVIGATING A NATIONAL EMERGENCY: Today, President Donald J. Trump enacted an Executive Order that levies tariffs on India as a direct consequence of its ongoing oil transactions with the Russian Federation. This order also opens the door for potential tariffs on other nations that engage in similar oil imports.
- The President has determined that India is actively importing oil from the Russian Federation. In light of the national emergency resulting from the Russian government’s hostile actions against Ukraine, he has imposed an additional 25% tariff on imports from India, effective August 27. This measure targets India’s direct or indirect oil purchases from Russia.
- This tariff is in addition to any other existing duties, fees, taxes, or charges applicable to such imports, unless subject to previous or future actions under section 232 of the Trade Expansion Act of 1962.
- This tariff also supplements any existing tariffs under Executive Order 14257, dated April 2, 2025, as amended. However, the additional 25% tariff will not be applied to items listed in Annex II of Executive Order 14257.
- The Secretary of Commerce, in collaboration with the Secretaries of State and Treasury, along with other senior officials, will assess whether additional countries are involved in the direct or indirect importation of Russian oil and will recommend further action to the President as necessary.
