By the authority granted to me as President under the Constitution and the laws of the United States, this order is issued:

Section 1. Purpose. The United States is at the forefront of Artificial Intelligence (AI) innovation due to the exceptional talent within our AI industry, and our commitment to avoid hindering this innovation with excessive regulations. My Administration has driven significant technological advancement and economic investment in AI by removing the bureaucratic limitations imposed by the previous administration on American AI developers and researchers, fostering AI innovation and speeding up the adoption of responsible AI in both government and industry.

While advanced AI capabilities bolster our Nation’s strength, they also present new national security issues that necessitate coordinated efforts across executive departments, agencies, and components. As these capabilities progress, my Administration will continue collaborating closely with the industry to ensure the deployment of the best and most secure technology to address any threats to our country swiftly. We will persist in leading an America First cybersecurity strategy that enhances both national security and our global AI leadership.

The United States’ policy is to promote AI innovation and security by engaging with the private sector to modernize and protect both government and private sector information systems against external threats. This involves safeguarding American ingenuity and intellectual property from adversarial exploitation and theft, and fostering America’s advanced AI-enabled capabilities.

Sec. 2. Upgrading American Systems for Advanced AI. (a) Within 30 days of this order, the Committee on National Security Systems will prioritize the cyber defense of National Security Systems, as defined in 44 U.S.C. 3552(b)(6)(A), by taking necessary and swift actions aligned with the order’s purpose.

(b) Within 30 days of this order, the Secretary of War will focus on enhancing the cyber defense of Department of War information systems by taking necessary and swift actions aligned with the order’s purpose.

(c) Within 30 days of this order, the Secretary of Homeland Security, through the Director of the Cybersecurity and Infrastructure Security Agency (CISA) and in consultation with the Director of the Office of Management and Budget (OMB), the Assistant to the President for National Security Affairs, and the National Cyber Director, will issue Binding Operational Directives and other appropriate guidance to:

(i) expedite and prioritize civilian Federal Government information systems’ cyber defense to safeguard our Nation’s critical functions;

(ii) establish or expand Federal programs and cybersecurity services that boost AI-enabled defensive tools; and

(iii) enhance access to cybersecurity tools and services, including, where suitable, covered frontier models for agencies, State and local authorities, and critical infrastructure operators such as rural hospitals, community banks, and local utilities.

(d) Within 30 days of this order, the Secretary of the Treasury, in collaboration with the National Cyber Director, the Secretary of War, through the Director of the National Security Agency (NSA), and the Secretary of Homeland Security, through the Director of CISA, will establish an AI cybersecurity clearinghouse. This will involve voluntary cooperation with the AI industry and critical infrastructure operators to coordinate and resolve software vulnerability scanning, discover and validate these vulnerabilities, and manage and prioritize vulnerability patch remediation and distribution.

(e) Within 30 days of this order, the Director of OMB, in coordination with the National Cyber Director and the Director of CISA, will assess whether any Federal grant programs have relevant funding available to support applicants developing advanced AI vulnerability detection.

(f) Within 60 days of this order, the Director of the Office of Personnel Management will expand the United States Tech Force Information Cybersecurity Specialist hiring and placement pathways.

Sec. 3. Secure Frontier Model Deployment. Within 60 days of this order, the Secretary of the Treasury, the Secretary of War, through the Director of NSA, and the Secretary of Homeland Security, through the Director of CISA, in consultation with the White House Chief of Staff, through the National Cyber Director, the Assistant to the President for Science and Technology (APST), and the Secretary of Commerce, through the Director of the National Institute of Standards and Technology, and in coordination with other appropriate agencies, will:

(a) develop and maintain a classified benchmarking process to assess the advanced cyber capabilities of AI models and establish the threshold for designating an AI model as a “covered frontier model” for this order. These assessments will be shared with AI developers and researchers as appropriate. The Director of NSA, in consultation with the National Cyber Director, the APST, the Director of CISA, and other representatives of the Department of War, will make such determinations.

(b) design a voluntary framework with AI developers that allows developers to:

(i) engage with the Federal Government to determine whether models under development qualify as “covered frontier models”;

(ii) grant the Federal Government access to covered frontier models, subject to confidentiality, cybersecurity, insider-risk, and intellectual-property protection, use, and nondisclosure agreements, for up to 30 days before releasing them to other trusted partners; and

(iii) collaborate with the Federal Government to select trusted partners for early access to covered frontier models, promoting secure innovation and enhancing critical infrastructure cybersecurity.

(c) Nothing in this section authorizes the creation of a mandatory governmental licensing, preclearance, or permitting requirement for developing, publishing, releasing, or distributing new AI models, including frontier models.

Sec. 4. Protection Against Criminal Actors. The Attorney General will prioritize enforcing 18 U.S.C. 1028, 18 U.S.C. 1030, 18 U.S.C. 1343, and other relevant Federal criminal laws against individuals using AI to illegally access or damage a computer without authorization, or using AI in such illegal access to commit any other crime. This includes breaching any public or private IT system or employing AI agents to unlawfully access data or information for criminal or unlawful purposes.

Sec. 5. General Provisions. (a) This order does not impair or otherwise affect:

(i) authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget regarding budgetary, administrative, or legislative proposals.

(b) This order will be carried out in accordance with applicable law and contingent upon the availability of appropriations.

(c) This order does not create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

(d) The Department of War will cover the publication costs of this order.
