SUBJECT: Purging Discrimination and Ideologically Driven Equity from the Foreign Service
Section 1. Policy and Purpose. In recent years, the Federal Government has seen the infiltration of divisive policies that prioritize ideology over merit. This memorandum aims to reaffirm that hiring for foreign policy roles, as in all government sectors, should be grounded in meritocracy rather than in a framework of discriminatory equity.
Sec. 2. Definitions. For clarity in this memorandum:
(a) “discriminatory equity ideology” is defined according to section 2 of Executive Order 14190 dated January 29, 2025 (Ending Radical Indoctrination in K-12 Schooling);
(b) The terms “Department,” “Foreign Service,” and “Secretary” refer to the definitions provided in 22 U.S.C. 3902; and
(c) “Foreign Service Member” is defined as per 22 U.S.C. 3903.
Sec. 3. Commitment to Equality and Non-Discrimination in the Foreign Service. (a) The Secretary of State is tasked with revising the 2022-2025 Decision Criteria for Tenure and Promotion within the Foreign Service. This revision must eliminate any references to the Core Precept titled “Diversity, Equity, Inclusion, and Accessibility.” All departmental employees will be instructed to disregard this Core Precept.
(b) All Secretaries shall direct their officers and employees to refrain from:
(i) Utilizing an individual’s race, color, religion, sex, or national origin as criteria for decisions regarding recruitment, hiring, promotion, or retention within the Foreign Service; or
(ii) Promoting or endorsing discriminatory equity ideology while acting in an official capacity.
(c) The Secretaries will investigate any current Foreign Service Members suspected of having engaged in illegal discrimination based on race or other protected characteristics, including actions driven by discriminatory equity ideology. In alignment with Executive Order 14211 of February 12, 2025 (One Voice for America’s Foreign Relations), the Secretaries shall:
(i) Take necessary actions against Foreign Service Members appointed by them who are found to engage in such discrimination; and
(ii) Decide whether to escalate findings of discrimination involving Foreign Service Members appointed by the President for his consideration, or to take appropriate action under their own authority.
Sec. 4. General Provisions. (a) This memorandum should not be interpreted as limiting the legal authority granted to any executive department or agency, or their respective leaders; nor should it affect the functions of the Director of the Office of Management and Budget in relation to budgetary, administrative, or legislative proposals.
(b) Implementation of this memorandum must comply with applicable laws and is subject to the availability of appropriations.
(c) This memorandum does not create any rights or benefits, either substantive or procedural, that can be enforced at law or in equity against the United States, its departments, agencies, or entities, their officers, employees, or agents, or any individual.
