The pharmaceutical industry middlemen known as Pharmacy Benefit Managers (PBMs) have long been under scrutiny for their opaque practices when negotiating drug prices and determining formularies for commercial payers and insurers. Recently, the Federal Trade Commission (FTC) issued a scathing report in July 2024, highlighting the lack of transparency and various forms of self-dealing within the industry. This led to a formal lawsuit against the three largest PBMs – Caremark Rx, Express Scripts, and Optum Rx – focusing specifically on their practices related to insulin.

In response to these issues, the bipartisan Continuing Resolution HR II was introduced, which included Section 227: Modernizing and Ensuring PBM Accountability. While this section was ultimately defeated, it was praised for its potential to bring about much-needed reforms in the PBM industry. However, upon closer inspection, it was evident that the proposed legislation would have perpetuated some of the questionable business practices of PBMs, particularly in relation to rebates from manufacturers.

One of the main criticisms of PBMs is their practice of receiving rebates from drug manufacturers, which can influence formulary placement decisions and ultimately lead to higher costs for patients. The proposed legislation aimed to redirect these rebates entirely to plan sponsors, but the fundamental issue of rebates distorting decision-making processes remained unresolved.

Furthermore, the bill failed to address the lack of transparency in PBM operations, instead introducing extensive reporting requirements that could potentially drive up costs without providing tangible benefits for patients. Additionally, the legislation left the determination of fair market value for PBM fees to the Secretary of Health and Human Services, raising concerns about the lack of competitive market forces in fee negotiations.

While the need for PBM reform is evident, the proposed legislation fell short of addressing the core issues plaguing the industry. It seemed to be a veiled attempt at maintaining the status quo rather than implementing meaningful change. Moving forward, Congress may need to reconsider its approach to PBM reform and focus on solutions that truly prioritize transparency, affordability, and patient well-being. The world of technology is constantly evolving, with new innovations and advancements being made every day. Another industry that is benefiting from AI technology is finance. AI algorithms are being used to analyze market trends, predict stock prices, and even detect fraudulent activity. This can help financial institutions make more informed investment decisions and protect their customers from financial scams. In the entertainment industry, AI technology is being used to create more personalized and immersive experiences for consumers. Streaming services like Netflix and Spotify use AI algorithms to recommend movies, TV shows, and music based on users’ preferences and viewing habits. This helps consumers discover new content that they may enjoy and keeps them engaged with the platform.

From healthcare to finance to entertainment, AI is revolutionizing the way we work, play, and live.
