Generative AI tools are making their way into legal proceedings, despite facing pushback from judges. While initial encounters with AI in courtrooms involved fake cases, the trend has evolved with the use of advanced AI video and audio tools. One recent example of this advancement occurred in an Arizona courtroom, where the family of a crime victim presented an AI-generated video of the victim addressing his alleged killer. The AI version of the victim, Chris Pelkey, appeared to speak directly to the court, urging forgiveness and reflection.

The video, which utilized an AI model trained on various clips of Pelkey, aimed to simulate what he might look like today. The judge, influenced by the emotional impact of the deepfake video, sentenced the perpetrator to 10.5 years in prison for manslaughter. This case marks a notable instance of using generative AI deepfakes in victim impact statements.

In a separate incident, a defendant in New York State court, Jerome Dewald, used an AI-generated deepfake video to aid in his legal defense during a contract dispute. Despite the judge’s disapproval of the use of AI without disclosure, Dewald claimed he intended to present his arguments efficiently rather than deceive the court.

These cases highlight the growing presence of generative AI in courtrooms, with lawyers utilizing large language models to draft legal filings and collect information. However, this trend has resulted in instances where AI models “hallucinate” fake legal cases, leading to sanctions and disciplinary actions against attorneys who submit fabricated information generated by AI tools.

As the use of AI in courtrooms continues to expand, questions surrounding the ethical and legal implications persist. While some believe AI can provide more accessible legal representation, others raise concerns about the potential for deception and manipulation. Recent efforts by judicial panels to regulate AI-generated evidence and Chief Justice John Roberts’ acknowledgment of the benefits and drawbacks of AI in the courtroom signal an ongoing debate about the role of generative AI in legal proceedings. As artificial intelligence continues to make its way into various aspects of our lives, including the legal system, concerns about privacy and dehumanization have come to the forefront. Recently, a prominent legal expert warned that the increasing use of AI in courtrooms could pose risks to privacy and potentially dehumanize the law.

While the use of AI technology in legal proceedings can streamline processes and improve efficiency, there are valid concerns about the potential invasion of privacy and the dehumanizing effects it may have on the justice system. As AI becomes more prevalent in courtrooms, it is essential to strike a balance between leveraging the benefits of technology and safeguarding individual privacy rights.

Despite these concerns, it seems that AI’s presence in courtrooms is only set to grow in the coming years. The integration of AI tools and algorithms in legal proceedings is expected to increase, as more courts and legal professionals recognize the potential benefits of these technologies.

It is crucial for policymakers, legal experts, and technology developers to work together to address these concerns and ensure that the use of AI in courtrooms is done responsibly and ethically. By implementing robust privacy safeguards and monitoring the impact of AI on the legal system, we can harness the benefits of technology while mitigating potential risks.

In conclusion, the integration of AI in courtrooms presents both opportunities and challenges. While it has the potential to streamline legal processes and improve access to justice, there are valid concerns about privacy invasion and dehumanization. As we navigate this evolving landscape, it is essential to prioritize privacy protection and ethical considerations to ensure that AI enhances rather than undermines the justice system.
