For many years, foreign students could enter the United States on a student visa and remain for decades, as long as they were enrolled in some classes. This practice is now set to change.

The Department of Homeland Security under Trump’s administration has introduced significant modifications to the student visa program, primarily focusing on the duration a foreign student can stay in the U.S. The new limit is four years, aligning with the typical time required to earn a college degree.

Although these changes were implemented in July, they are gaining attention now as the policy is set to take effect next month.

This longstanding system has been exploited by individuals who enter the country and never leave. These reforms are seen as necessary and overdue.

The DHS issued a press release regarding this matter:

Trump Administration Issues Final Rule to End Foreign Student Visa Abuse

The Department of Homeland Security (DHS) has announced the release of a final rule that closes the “duration of status” loophole, which allowed foreign students, exchange visitors, and media representatives to remain in the U.S. indefinitely without regular government oversight.

The new regulation mandates a fixed admission period for nonimmigrant visa holders in F, J, and I categories. This change aims to restore the integrity of the nation’s immigration system, address widespread visa misuse, and enhance national security through consistent vetting. A similar fixed admission period is already applied to many other nonimmigrant visa types.

“For nearly half a century, the outdated ‘duration of status’ system has compromised national security and created an environment ripe for immigration fraud,” said DHS Secretary Markwayne Mullin. “For decades, foreign students have been admitted into the U.S. indefinitely, allowing thousands to abuse our immigration system by perpetually enrolling in courses to avoid having to leave the U.S. By implementing clear, finite limits on these visas, the United States is reclaiming its ability to properly screen, vet, and monitor individuals within our borders. This final rule ensures that foreign students remain focused on their primary purpose: completing their studies and returning home.”

Since 1978, foreign students have been allowed into the U.S. for an unspecified duration, enabling many to become “forever students” by continuously enrolling in courses to evade departure. The final rule puts an end to this exploitation through several key reforms:

  • Fixed Admission Caps: Nonimmigrant students (F visas) and exchange visitors (J visas) will be granted admission for the duration of their specific program, but not exceeding four years.
  • Mandatory Federal Extensions: Visa holders who need more time to complete an academic program must apply for an Extension of Stay (EOS) through U.S. Citizenship and Immigration Services (USCIS). This shifts oversight from university staff to federal authorities and subjects applicants to biometric vetting, background checks, and fraud screenings.
  • Reduced Departure Grace Period: The time F-1 students have to prepare for departure, transfer schools, or change status after graduation is reduced from 60 days to 30 days.
  • Program Change Restrictions: The rule enforces strict limitations on academic changes.

This initiative is expected to have a significant, positive impact by reducing the number of people residing in the country illegally.
