The Justice Department lawyer argued that the president has the authority to seize control of states’ National Guard units, even during peacetime, to support Immigration and Customs Enforcement agents. This assertion of presidential power has raised concerns about the administration’s efforts to expand the president’s authority and erode the long-standing tradition of keeping the military separate from domestic law enforcement. California’s governor has sued over Trump’s mobilization of the state’s troops, with a judge ruling that Trump’s actions were illegal. Despite this, the 9th Circuit Court of Appeals has allowed the soldiers to remain under Trump’s control for now. Trump has also threatened to deploy ICE for raids in major cities, and the administration’s arguments suggest that troops could be involved in these operations. The memo used to federalize California’s National Guard does not specify locations and is described as unprecedented in American history. The administration maintains that protests triggering federalization of the National Guard troops fall under a specific section of the U.S. Code, giving the president broad and unreviewable power to deploy troops. During a court hearing, a judge posed a hypothetical scenario in which Trump could commandeer National Guard troops even in peaceful situations, to which the Justice Department lawyer indicated that it could be a possibility.
