U.S. District Court Judge LaShonda Hunt, a federal judge appointed by President Biden, has issued a striking ruling requiring the Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) to remove a controversial security fence surrounding the immigration processing facility in Broadview, Illinois. This facility has been at the epicenter of turbulent protests aimed at ICE, particularly following President Trump’s Operation Midway Blitz that intensified earlier this fall.
In her comprehensive 18-page ruling, Judge Hunt criticized DHS for ‘commandeering municipal property’ and deemed the fence a hazardous obstacle that obstructs local emergency services, especially essential for fire trucks and ambulances during urgent responses to emergencies in proximity to the facility. “The Federal Defendants’ prohibition of unencumbered access to municipal streets has hindered the Village’s ability to uphold its ordinances to safeguard public health and welfare, leading to irreparable harm. The Court concurs,” Hunt articulated in her judgement.
The installation of this fence was a direct response to violent demonstrations that erupted in the wake of a substantial crackdown on criminal illegal aliens across the broader Chicago area and its surrounding sanctuary suburbs. As tensions rose, ICE officials argued that this barrier was imperative for the safety of both staff and detainees, citing instances of vandalism and threats to vehicular access due to obstructive protests.
However, Judge Hunt aligned herself with Broadview’s Democratic Mayor, Katrina Thompson, who vehemently contested the legality of the fence, asserting that it effectively barred the Broadview Fire Department from reaching the facility in case of emergencies.
This judicial ruling fundamentally disrupts the DHS’s security protocols, previously established to protect against repeated assaults on ICE personnel. The ruling demands that DHS dismantle the Broadview fence by midnight on Tuesday, restoring Beach Street’s control to the Village of Broadview. Federal officials now face the dilemma of complying or appealing the injunction within the specified timeframe.
