Kevin Costner is making another attempt to have a judge dismiss a sexual harassment lawsuit brought against him by a stunt performer. The performer alleges that she was coerced into participating in an unplanned and unscripted rape scene on the set of the Western film series, “Horizon.”
The judge had previously dismissed two out of the ten claims made by Devyn Labella, prompting Costner to appeal the decision in an effort to have the remaining eight claims thrown out. Legal documents obtained by TMZ confirm Costner’s appeal.
Costner’s attorney, Marty Singer, had previously stated his intention to appeal the judge’s ruling, and he followed through with the appeal on Thursday afternoon.

In her lawsuit filed in May, LaBella alleges that she was pressured into participating in a violent rape scene that was not part of the original script for “Horizon.”
Costner has vehemently denied the existence of any non-consensual or violent scenes on the set and has characterized LaBella’s lawsuit as a baseless extortion attempt.
After filing a motion to dismiss the lawsuit in August, Costner is now pursuing another legal avenue to have the case thrown out.
